I'm not saying that we should continue to force students to listen to crappy lectures by teachers that only give lectures cause it funds their research. What I am saying is that research is often times important and we need an alternate way of funding it.

Feed Techdirt: Study Shows How Notice-And-Takedown Reduces Transaction Costs In Making Works Le (google.com)

We've written a few times in the past about research done by Paul Heald on copyright and its impact on the availability of certain content. He's recently published an interesting new study on how the DMCA's notice-and-takedown regime facilitates making content available by decreasing transaction costs among parties. As we've discussed at length, the entertainment industry's main focus in the next round of copyright reform is to wipe out the notice-and-takedown provisions of the DMCA. The legacy recording and movie industries want everyone else to act as copyright cops, and hate the idea that notice-and-takedown puts the initial burden on themselves as copyright holders.

However, Heald's research looks at music on YouTube and concludes that the notice-and-takedown system has actually enabled much greater authorized availability of music, by reducing transaction costs. The idea is pretty straightforward. Without a notice-and-takedown provision, someone who wants to post music to YouTube needs to go out and seek a license. Of course, getting permission from all the various rightsholders is frequently impossible. The transaction costs of getting permission make it such that it's way too high. Yet, with notice-and-takedown, the person can upload the content without permission, and then the copyright holder is given the option of what to do with it. On YouTube, that includes the option of monetizing it, thus "authorizing" the use. That creates a natural experiment for Heald to explore, in which he can see how much content is "authorized" thanks to such a setup. And the result, not surprisingly, is that this system has enabled much greater authorized (and monetized) access to music than an alternative, high transaction cost system, under which uploaders must first seek out permission to upload everything.

In fact, the analysis shows a tremendous number of popular music hits from the US from 1930 to 1960 are available in what's likely an authorized (i.e., monetized) fashion, even thought nearly all of it was almost certainly uploaded by those without permission. Under the system that the RIAA and MPAA would like, this would be next to impossible. Instead, they'd want to negotiate deals first, making it nearly impossible for such works to be available, and meaning that both the availability and monetization of those works wouldn't be happening. As Heald concludes:

Congress should resist calls to dismantle platforms like YouTube which take advantage of current limits on secondary liability to create a marketplace that radically reduces the high cost of negotiating over rights to music and visual content. The access YouTube provides to valuable cultural products is far from perfect, but it provides a partial solution to the problem of disappearing works, at least in the music context. In any event, no new legislative initiative should proceed in the absence of concrete data testing the claim of copyright owners that their proposals make works more, rather than less, available to the public.

Technically, God's got plenty of loophole territory in that statement, but with the bible it's also the spirit (pun not intended) of things that counts - and a promise to never send another great flood would be contradicted by any (scientific prediction of) massive sea level rise and subsequent flooding of large portions of the Earth's human-habitable land.

The biggest problem I have with this is not that Mann's science might be wrong, but that the methods being used to discredit the science are anything but scientific. We have entered a scary, new era in Western thought where conformity of thought is valued above all else, and anyone who dares advocate a position which could be considered controversial or offensive is railroaded into silence by whatever means necessary.

The "Speak No Evil" crowd is destroying a great Western tradition of open and honest debate. These folks are committing offenses against truth itself, destroying civilization in the process.

I was under the impression that the ClimateGate affair was old news and Mann had been discredited already; why would they bother pursuing this more than half a decade later? It seems their objective is not merely to win the debate, or merely suppress an unpopular opinion, but to prevent any debate, research, or independent inquiry from taking place from this point on.

It's called making an example of someone. It's objective is to so thoroughly exasperate the target that their response becomes so extreme as to become unbelievable by the public at large. If they can't keep you from speaking, they can make others believe that either:

  1. You are so extreme in your position that your judgement cannot be trusted, or
  2. If anyone else dares to speak up that their life will be ruined by the onslaught of specious and frivolous inquiries, innuendos, lies, etc...

Michael Mann's ordeal serves the interest of the fossil fuel companies regardless of the outcome of the case.

It does not, however, serve the greater public interest. Even though I believe Mann to be mistaken, I'm quite certain that we the public cannot be adequately informed in an environment such as this.

Sure it seems innocent now, a reduction of 10-20% in your insurance rates now (woo hoo). But then next thing you know you are speeding (5-10 mph over) through a GREEN light with the flow of traffic and get T-boned. Now the person who T-boned you will likely get charged, and you will get off without a charge because you didn't cause the accident. The cop never caught you speeding so in the eyes of the law you are ok.

Now comes the Progressive monitoring device. Your insurance company has a policy (that you agreed too when you signed up with them) saying that they can pull the data from the monitoring unit at any time. Maybe it's even automatic telemetry where it get's reported in real-time. Your insurance company pays to have your car fixed, and all appears well. Six months later you notice your premiums go up drastically even through you were not at fault and were no charged by the police.

What has happened? Your insurance company has looked at the data and decided that because you were speeding you breaking the law and thus a higher risk driver! Bingo your rates increased and all because you VOLUNTARILY gave the insurance company the ability to monitor your every move. Insurance companies do NOT have your best interests in mind - their primary goal like all for-profit corporations is to MAKE money. They simply can't be trusted.

People say, yes but if I have one of those units and I never speed! I say, BS! I have very rarely met anybody who drives perfectly in the eyes of the insurance companies or the law. It's human nature to occasionally (or always) speed and break minor traffic laws.

Drones were used in the first Gulf War in 1991, and it was big news when they were first used in a targeted killing in 2002.

I think if you asked the average educated person 15 years ago about these things, they'd call them all either plausible or obvious developments. You'd have to be stunningly ignorant to disbelieve some of those.
