An anonymous reader quotes a report from Quartz: The biggest and perhaps best source of data about what people like to watch on the internet and what they would pay for doesn't come from streaming giants like Netflix, Amazon Prime Video, or Hulu. It comes from porn. While consuming porn is typically a private and personal affair, porn sites still track your every move: What content you choose, which moments you pause, which parts you repeat. By mining this data to a deeper degree than other streaming services, many porn sites are able to give internet users exactly what they want -- and they want a lot of it. [...] MindGeek is the world's biggest porn company -- more specifically, it's a holding company that owns numerous adult entertainment sites and production companies, including the Pornhub Network. Like other streaming giants, MindGeek's sites analyze user data, but the company has an edge when it comes to producing tailor-made content in-house. With at least 125 million daily visits, MindGeek has a massive range of users to draw data from and create content for.

The average user can watch as much porn as they'd like without so much as making an account, let alone paying, but in exchange for meeting desires that can't always be met elsewhere, companies like MindGeek access user data because the user more willingly lets them. And it eventually pays off, when users decide to pay for premium content and the habits of paying subscribers become even clearer. What's more, Pornhub, in particular, operates one of the most sophisticated digital data analysis operations that caters primarily to users and not advertisers. Pornhub Insights provides transparency into its data collection -- on the most intimate of subjects -- by making research and analysis from billions of data points about viewership patterns, often tied to events from politics to pop culture, available to the public. It offers more than many other tech giants do.

Netflix Will Now Interrupt Series Binges With Video Ads For Its Other Series (arstechnica.com) 184

Netflix has confirmed that it will start airing video ads for other Netflix series between episodes. These ads will reportedly only be for Netflix content, not outside products or content, and will, at least for now, only appear for a "segment" of Netflix's user base. Ars Technica reports: The news emerged via user reports, particularly on the primary Netflix Reddit community, in which users claimed that ads for entirely different series would play between episodes of a given show's binging. One initial claim said that "unskippable" ads for the AMC series Better Call Saul appeared between episodes of Rick & Morty, and that this ad appeared while using Netflix's smart TV app on an LG set in the UK. Replies to that thread included an allegation that a video ad for I Am A Killer (a Netflix-produced true-crime series) appeared between episodes of the animated comedy Bob's Burgers.

In a statement given to Ars Technica, Netflix described the change as follows: "We are testing whether surfacing recommendations between episodes helps members discover stories they will enjoy faster." The reasoning, Netflix's statement says, comes from its last controversial decision: to add auto-playing videos, complete with unmuteable audio, while browsing through Netflix content. Netflix offered one major rebuttal to at least one Reddit claim, pointing out that the ads for Netflix content are entirely skippable.

Netflix's Subscriber Growth Stalls (bbc.co.uk) 165

Netflix shares plunged by more than 14% on Monday, after the firm reported disappointing subscriber growth. While the entertainment service added 5.2 million subscribers last quarter, it forecasted a growth of 6.2 million. BBC reports: Investors are worried about Netflix's growth potential in the face of increased competition from tech giants such as Apple, YouTube and Amazon, as well as traditional firms, which have started to invest more in online streaming. Disney, for example, plans to launch its own streaming service and stop licensing some of its material to Netflix.

In a letter to investors, Netflix called it a "strong but not stellar quarter," ending with about 130 million subscribers globally. The firm added just 670,000 subscribers in the U.S. -- far short of the more than one million it added in the second quarter of 2017. It added 4.5 million subscribers internationally, fewer than the two most recent quarters but up 8% year-on-year. However, it said its finances were strong. The company reported $3.9 billion in quarterly revenue, up 40% compared to the second quarter of 2017. Profits totaled $384.3 million, almost six times the figure during the same period a year ago.

'Pirates' Tend To Be the Biggest Buyers of Legal Content, Study Shows (vice.com) 108

An anonymous reader quotes a report from Motherboard: According to a paywalled survey of 1,000 UK residents by anti-piracy outfit MUSO first spotted by Torrent Freak, 60 percent of those surveyed admitted that they had illegally streamed or downloaded music, film, or TV shows sometime in the past. But the study also showed that 83 percent of those questioned try to find the content they are looking for through above board services before trying anything else. And while the study found that 86 percent of survey takers subscribe to a streaming subscription service like Netflix, that total jumped to 91 percent among those that admit to piracy. The survey found that the top reason that users pirate is the content they were looking for wasn't legally available (34 percent) was too cumbersome or difficult to access (34 percent), or wasn't affordable (35 percent). "The entertainment industry tends to envisage piracy audiences as a criminal element, and writes them off as money lost -- but they are wrong to do so," MUSO executive Paul Briley said of the study's findings. "The reality is that the majority of people who have gone through the effort of finding and accessing such unlicensed content are, first and foremost, fans -- fans who are more often than not trying to get content legally if they can," Briley added.

EU's Long-Promised Digital Media Portability Rules Go Into Effect (wired.co.uk) 35

The EU's long-promised digital media portability rules have taken effect as of April 1st, letting residents access Netflix, Amazon Prime Video and other paid digital media services in other member countries as if they were still at home. From a report: The European Commission's 'digital single market strategy,' which last year claimed victory over mobile roaming charges, has now lead to it passing the 'portability regulation,' which will allow users around the EU to use region locked services more freely while travelling abroad. Under currently active rules, what content is available in a certain territory is based on the specific local rights that a provider has secured. The new rules allow for what Phil Sherrell, head of international media, entertainment and sport for international law firm Bird and Bird, calls "copyright fiction," allowing the normal rules to be bent temporarily while a user is travelling.

The regulation was originally passed in June 2017, but the nine-month period given to rights holders and service providers to prepare is about to expire, and thereby making the rules enforceable. From today, content providers, whether their products are videos, music, games, live sport or e-books, will use their subscribers' details to validate their home country, and let them access all the usual content and services available in that location all around the Union.

UK Wants To Criminalize Re-Identification of Anonymized User Data (bleepingcomputer.com) 120

An anonymous reader writes: European countries are currently implementing new data protection laws. Recently, despite leaving the European Union, the United Kingdom has expressed intent to implement the law called General Data Protection Regulation. As an extension, the UK wants to to ban re-identification (with a penalty of unlimited fines), the method of reversing anonymization, or pointing out the weakness of the used anonymisation process. One famous example was research re-identifying Netflix users from published datasets. By banning re-identification, UK follows the lead of Australia which is considering enacting similarly controversial law that can lead to making privacy research difficult or impossible. Privacy researchers express concerns about the effectiveness of the law that could even complicate security, a view shared by privacy advocates.

Netflix's First Takeover: a Comics Firm (bbc.com) 37

Netflix announced today that it is acquiring Mark Millar, a well-known name in the world of comics. As part of the deal, the on-demand streaming company said, it will be creating original movies and TV shows from the content. It's Netflix's first acquisition. From a report: Millarworld, founded by Mark Millar from Coatbridge, includes his portfolio of characters and stories such as Kick-Ass, Kingsman, and Old Man Logan. Mr Millar said he was still "blinking" over the news. He said it was only the third time a comic book purchase on this scale had ever happened, with Warner Bros buying DC Comics in 1968, and Disney buying Marvel in 2009. Mr Millar, who lives in Glasgow, started Millarworld as a creator-owned comic-book company nearly 15 years ago. He runs the company with his wife Lucy Millar. It is the first ever company acquisition in Netflix's history. The terms of the transaction were not disclosed. Mr Millar said: "I'm so in love with what Netflix is doing and excited by their plans. Netflix is the future and Millarworld couldn't have a better home."

Reader OneHundredAndTen writes and shares a report: Systemd doing what it does best. From a report on The Register: A few Penguinistas spent a weekend working out why they can't get through to Netflix from their Linux machines, because when they tried, their DNS lookups failed. The issue emerged over the weekend, when Gentoo user Dennis Schridde submitted a bug report to the Systemd project. Essentially, he described a failure within systemd-resolve, a Systemd component that turns human-readable domain names into IP addresses for software, like web browsers, to connect to. The Systemd resolver couldn't look up Netflix's servers for Schridde's web browser, according to the report. In his detailed post, Schridde said he expected this to happen: ipv6_1-cxl0-c088.1.lhr004.ix.nflxvideo.net gets resolved to 37.77.187.142 or 2a00:86c0:5:5::142. When in reality, that wasn't happening, so Netflix couldn't be reached on his box. His speculation that libidn2, which adds internationalised domain names support to the resolver, was at fault turned out to be accurate. Rebuilding Systemd without that library cleared the problem.

Troll With 'Stupid Patent' Sues EFF. EFF Sues Them Back (arstechnica.com) 68

"The Electronic Frontier Foundation has sued an Australian company that it previously dubbed as a 'classic patent troll' in a June 2016 blog post entitled: Stupid Patent of the Month: Storage Cabinets on a Computer." An anonymous reader quotes Ars Technica: Last year, that company, Global Equity Management (SA) Pty. Ltd. (GEMSA), managed to get an Australian court to order EFF to remove its post -- but EFF did not comply. In January 2017, Pasha Mehr, an attorney representing GEMSA, further demanded that the article be removed and that EFF pay $750,000. EFF still did not comply. The new lawsuit, filed in federal court in San Francisco on Wednesday, asks that the American court declare the Australian ruling unenforceable in the U.S.
GEMSA's attorneys reportedly threatened to have the EFF's post de-indexed from search engine listings -- on the basis of the Australian court order -- so now the EFF "seeks a court order declaring the Australian injunction 'repugnant' to the U.S. Constitution and unenforceable in the United States."

The Register reports that GEMSA has already sued 37 companies, "including big-name tech companies Airbnb, Uber, Netflix, Spotify, and eBay. In each case, GEMSA accused the company's website design of somehow trampling on the GUI patent without permission." But things were different after the EFF's article, according to Courthouse News. "GEMSA said the article made it harder to enforce its patents in the United States, citing its legal opponents' 'reduced interest in pursuing pre-trial settlement negotiations.'"

W3C Erects DRM As Web Standard (theregister.co.uk) 260

The World Wide Web Consortium (W3C) has formally put forward highly controversial digital rights management as a new web standard. "Dubbed Encrypted Media Extensions (EME), this anti-piracy mechanism was crafted by engineers from Google, Microsoft, and Netflix, and has been in development for some time," reports The Register. "The DRM is supposed to thwart copyright infringement by stopping people from ripping video and other content from encrypted high-quality streams." From the report: The latest draft was published last week and formally put forward as a proposed standard soon after. Under W3C rules, a decision over whether to officially adopt EME will depend on a poll of its members. That survey was sent out yesterday and member organizations, who pay an annual fee that varies from $2,250 for the smallest non-profits to $77,000 for larger corporations, will have until April 19 to register their opinions. If EME gets the consortium's rubber stamp of approval, it will lock down the standard for web browsers and video streamers to implement and roll out. The proposed standard is expected to succeed, especially after web founder and W3C director Sir Tim Berners-Lee personally endorsed the measure, arguing that the standard simply reflects modern realities and would allow for greater interoperability and improve online privacy. But EME still faces considerable opposition. One of its most persistent vocal opponents, Cory Doctorow of the Electronic Frontier Foundation, argues that EME "would give corporations the new right to sue people who engaged in legal activity." He is referring to the most recent controversy where the W3C has tried to strike a balance between legitimate security researchers investigating vulnerabilities in digital rights management software, and hackers trying to circumvent content protection. The W3C notes that the EME specification includes sections on security and privacy, but concedes "the lack of consensus to protect security researchers remains an issue." Its proposed solution remains "establishing best practices for responsible vulnerability disclosure." It also notes that issues of accessibility were ruled to be outside the scope of the EME, although there is an entire webpage dedicated to those issues and finding solutions to them.

Streaming Pirate Content Isn't Illegal, UK Trading Standards Says (torrentfreak.com) 70

Every day millions of people use PCs, tablets, phones and Kodi-style devices to stream pirated content, but is it illegal? According to Trading Standards, local UK authorities tasked with investigating commercial organizations, if users only stream and don't download, they're likely exempt from copyright law. An anonymous reader shares a TorrentFreak report: "Accessing premium paid-for content without a subscription is considered by the industry as unlawful access, although streaming something online, rather than downloading a file, is likely to be exempt from copyright laws," the spokesperson added. This statement certainly carries some weight. Although in a different region of the UK, Trading Standards is the driving force behind the prosecution of Kodi box seller Brian Thompson who entered a not guilty plea in January. He'll face a trial in a couple of months but it now seems more clear than ever that his customers and millions like them around the country are not breaking the law, a position that's shared by the EU Commission.

Netflix Calls Out HBO For Not Letting Subscribers Binge On New Shows (arstechnica.com) 59

An anonymous reader quotes a report from Ars Technica: Netflix has gleefully poked a stick at its competitors in the video streaming market, after revealing it had added more than seven million subscribers to its service in the last three months of 2016. HBO also got a special mention. In a letter to shareholders, the company's boss Reed Hastings teased the TV drama maker by noting that, if the BBC was willing to stream shows before they air on television, then maybe HBO -- which has rigidly stuck to its strategy of eking out episodes to viewers -- should do the same. He said: "[...] the BBC has become the first major linear network to announce plans to go binge-first with new seasons, favoring internet over linear viewers. We presume HBO is not far behind the BBC. In short, it's becoming an Internet TV world, which presents both challenges and opportunities for Netflix as we strive to earn screen time." But it's worth noting that HBO currently has an exclusive deal with Sky in the UK, Ireland, Germany, Austria, and Italy, allowing the broadcaster to have first-run rights on the likes of Game of Thrones and Westworld until 2020 -- so any such change isn't likely to happen in the near-term. Late last year, it struck a deal with Netflix rival Amazon, allowing Prime members in the US to sign up for a monthly HBO subscription. "We have a very successful partnership with this great company that continues to evolve," said HBO exec Sofia Chang in December. The company's HBO Now streaming service shows no sign of shifting strategy, either, with programs airing simultaneously on traditional TV and online.

Another Internet Outage Takes Down Services in US and UK (chicagotribune.com) 34

Reader Archangel Michael writes: Parts of the internet were down across the U.S. and in the U.K. Wednesday morning, as service provider Level 3 Communications reported an outage. Level 3, which provides internet and voice services to businesses, said the company did not yet know the cause of the outage, which temporarily disrupted or slowed service to some customers. "Our technical team is looking into this issue to determine the cause. Our priority is to ensure the reliability of our network and services. We will provide updates as more information becomes available," Nikki Wheeler, senior director of media relations, wrote in an email. The Broomfield, Colo.-based company is a Tier 1 provider, which means its network powers other internet and content providers. In 2015, it partnered with Verizon. It is also the content delivery network for Netflix and the HBO Go mobile app; a Blue Sky test of those services showed they seemed to be unaffected. ArsTechnica has more details.

The US companies could also be hit with taxes to raise funds to support the work of film-makers in Europe. The proposal is thought to be driven by the French, who are particularly fearful of their cinema and TV programmes being eclipsed by English language productions... One draft says the aims is to create 'a more level playing field in the promotion of European works by obliging on-demand services to reserve at least 20 percent share for European works in their catalogues and to ensure adequate prominence of such works'.
French may become the world's most-spoken language by 2050 (due to its popularity among the fast-growing population of Africa). But even so, should U.S.-based companies be facing "regional quotas" for the content they're offering?

Australia: VPN Users Aren't Breaching Copyright (abc.net.au) 117

Slashdot reader Zanadou writes: The Australian Government Productivity Commission in a draft report recommended that Australian consumers should be able to legally circumvent geoblocking restrictions that have prevented them from using foreign online streaming services like Netflix, and that the Australian Government needs to send a clear message that it is not an infringement of copyright for consumers to be able evade geoblocking technology. Karen Chester, a commissioner with the Productivity Commission, told the Australian Broadcasting Corporation that geoblocking restrictions have the opposite effect of encouraging internet piracy. "Making copyright material more accessible and more competitively priced online, and not geoblocking, is the best antidote to copyright infringement."

In probably related news, Australia topped the list of countries who illegally downloaded the Game Of Thrones season six premiere, this week.

In January Netflix's chief product officer admitted that the company has no magic solution to subscribers who use VPNs to circumvent geoblocking.

The Client Presence Verification (CPV) system presented in the paper utilises analysis of delays in network packets in order to determine the user's location, disregarding the IP address geolocation information which currently underpins the efforts of content providers such as Netflix to prevent VPN users accessing content which is not licensed in their country. The detection system was tested at global network laboratory PlanetLab using 80 network nodes based in the U.S. and Canada.

Most homes would be hard-pressed to consume data at this rate today, but these speeds will become necessary when over-the-top television services like Netflix and HBO GO become commonplace, television pixel densities grow to 8K (7680p X 4320p) at 60 to 120 fps, and the IoT connects every other home device to the internet. “We’re offering customers the chance to access absolutely phenomenal broadband speeds,” Gigaclear CEO Matthew Hare said in an official announcement. “To be clear, this is a premium service that gives the fastest Internet speeds in the country to those of our customers who want the best connection that they can get.”

Before Barbie's Brainy Makeover, Mattel Execs Met With White House, Google 125

theodp writes: Mattel came under fire last November over its portrayal of Computer Engineer Barbie as incompetent. But the toymaker is now drawing kudos for its new Imagine the Possibilities Barbie ad campaign (video), which shows little girls pretending to be professionals in real-life settings, including a college professor lecturing students about the brain. Ad Age, however, is cynical of the empowering spin on Barbie, which it says "comes across as a manipulative way to silence criticism." Interestingly, some of that criticism may have come from the White House.

WH Visitor Records show that Barbie's brainy makeover came after Mattel execs — Evelyn Mazzocco, Julia Pistor, Heather Lazarus — were summoned to the White House last April to meet with the White House Council on Women and Girls. A little Googling suggests other attendees at the sit-down included representatives of the nation's leading toy makers (Disney Consumer, Nickelodeon, Hasbro, American Girl), media giants (Disney Channels, Viacom, TIME, Scholastic, Univision, Participant Media, Cartoon Network, Netflix), retailers (Walmart, Target), educators, scientists, the U.S. Dept. of Education (including the Deputy Director of Michelle Obama's Reach Higher Initiative), philanthropists (Rockefeller, Harnisch Foundations) — and Google. Representing Google was CS Education in Media Program Manager Julie Ann Crommett, who has worked with Disney to shape programming to inspire girls to pursue CS in conjunction with the search giant's $50 million Made With Code initiative.

The April White House meeting appears to be a reschedule of a planned March meeting that was to have included other Mattel execs, including Stephanie Cota, Venetia Davie, and Lori Pantel, to whom the task of apologizing for Computer Engineer Barbie fell last November. For the first time in over a decade, Barbie was no longer the most popular girls' toy last holiday season, having lost her crown to Disney Princesses Elsa and Anna, who coincidentally teamed up with Google-backed Code.org last December to "teach President Obama to code" at a widely-publicized White House event.

Whereas Netflix and Spotify can deliver high quality streams to users in North America and Europe with superfast fixed and 4G connections, 50 percent of Bozza's traffic comes from feature phones. Data compression technology and transcoding techniques try and keep costs down, while Africa's mobile market is much less app-centric. Bozza founder Emma Kaye explains how she plans to help turn Bozza into a major medium platform.

Blackberry CEO: Net Neutrality Means Mandating Cross-Platform Apps 307

DW100 writes In a bizarre public blog post the CEO of BlackBerry, John Chen, has claimed that net neutrality laws should include forcing app developers to make their services available on all operating systems. Chen even goes as far as citing Apple's iMessage tool as a service that should be made available for BlackBerry, because at present the lack of an iMessage BlackBerry app is holding the firm back. Some excerpts from Chen's plea: Netflix, which has forcefully advocated carrier neutrality, has discriminated against BlackBerry customers by refusing to make its streaming movie service available to them. Many other applications providers similarly offer service only to iPhone and Android users. ... Neutrality must be mandated at the application and content layer if we truly want a free, open and non-discriminatory internet. All wireless broadband customers must have the ability to access any lawful applications and content they choose, and applications/content providers must be prohibited from discriminating based on the customer’s mobile operating system. Since "content providers" are writing code they think makes sense for one reason or another (expected returns financial or psychic), a mandate to write more code seems like a good way to re-learn why contract law frowns on specific performance.
