I don't think that is really the main the reason. If Microsoft wants to defend a charge of vicarious (i.e. they assisted others) infringement then they need only point to Sony Corp. of America v. Universal City Studios, Inc., 464 U.S. 417 (1984) [wikipedia.org] aka "the Betamax case" and make the Res Ipsa Loquitur [wikipedia.org] (the matter speaks for itself) case that the Windows OS has "substantial non-infringing uses".

A 38-year-old man who had been in a near-coma for six years was recently awakened via the use of a pacemaker and two electrodes which were implanted deeply in his brain. The electrical device, manufactured by a company called Medtronics, was used to send impulses to the area of the brain regulating consciousness, and researchers believe that the stimulation may be enhancing brain circuits that are still capable of functioning. The man, the first of 12 to undergo the procedure, has gone from a vegetative state to being able to play cards, speak with family members, and take trips outside. While this isn't exactly a new technology -- as doctors have been experimenting with deep-brain stimulation in the treatment of Parkinson's, epilepsy, and brain injuries for some time -- it is a clear sign that there's hope for patients whom the medical community has been, heretofore, unable to treat.

Submission + - European Galileo program in serious trouble

elrous0 writes: CNN, the Inquirer, et. al. are reporting that Europe's "Galileo" program is facing a serious financial and technical crisis and may be permanently stalled. The European program, designed to be a superior answer to the United States' "Global Positioning System" (GPS), has faced numerous hurdles since its incenption. To date, the Galileo program has succeeded in launching only one of its 30 planned satellites and has been beset by delays and cost overruns. Apparently, squabbling between the eight companies in the consortium behind the project is responsible for many of the problems. The project is now threatened with an EU takeover. But many are skeptical that even the EU can save the flagging program.

False. Like The Computer, Toast, and Marmite, The Internet is a superior British invention, invented by superior British minds in the heart of Britain. Research into a worldwide information network began in 1601 when Elizabeth I appointed Charles Blount (later 1st Earl of Devonshire) Master of Internet Information Systems. Being the only ICT-trained baron, Blount spent more time making repairs to Royal Laptops and setting up Royal Network Servers. Little progress was made until a British spy under the false identity of Antonio Santi Giuseppe Meucci announced his invention of the telephone. Then Master of Internet Information Systems Henry Phipps (1st Earl of Mulgrave, later disgraced when found to be using his post to distribute illegal copies of Victorian pornography--most un-English) found this invention allowed for much improvement over the previous method of carrying Internet messages, which involved a complex system of levers, pulleys, and mailmen. The later British invention of the computer itself further improved Internet capability.

If you had lived in England, been educated by the superior English educational system, and used the BBC as your only source of information, you would already know this. Al Gore is an inferior entity with little British blood in his veins. He shall be first against the wall when the revolution comes.
