Submission + - Possibly fatal blow against a patent trolls. (computerworld.com)

whoever57 writes: Patent trolls rely on the fact that they have no assets and, if they lose a case, they can fold the company that owned the patent and sued, thus avoiding paying any the defendant's legal bills. However, in a recent case, the judge has told the winning defendant that it can claim its legal bills from the law firm. The decision is based on the plaintiff's law firm using a contract under which it would take a portion of any judgment, making it more than just counsel, but instead a partner with the plaintiff. This will likely result in law firms wanting to be paid up front, instead of offering a contingency-based fee.

Submission + - Congressman Introduces Bill to Limit FCC Powers

An anonymous reader writes: Representative Bob Latta (R-OH) introduced a bill on Wednesday that would limit the FCC's power to regulate ISPs in a supposed effort to keep the internet free. The bill's text is currently not available on the Library of Congress webpage or on congress.gov, but a purported copy has been spotted on scribd. Representative Latta's press release nevertheless indicates that the bill is intended to prevent the FCC from re-classifying ISPs as common carriers under Title II. Latta is one of the 28 representatives who lobbied the FCC earlier this month and were shown to have received double the average monetary donations given to all House of Representative members from the cable industry over a two year period ending this past December.

EDlll, I am going to go a head and completely agree with NeutronCowboy; this was a very entertaining and insightful post: Putting succinctly what i have felt and stated so many times before to friends, family, and anyone who would listen really. As i approach 30 however, and am a new father, I can't help but force myself to be optimistic about the eventual outcome of all-too-likely "Revolution" that we seem to be headed for. Yes our individual rights will be slowly eroded piecemeal one by one in favor of the privileged few. But (and this is the only shred of hope i am holding on to) there will come a time when American society will be so draconian, so in your-face biased, so "unfair", and so contrary to the original ideals this country was founded on that smart people such as yourself and the good people at /. (or whatever future incarnation like it) will organize enough to actually be effective in changing things. Your scenario evolving the junior Senator from Complete-Awesomeness is bound to fail. This system is set up so one person CAN'T make any kind of big shifts in culture. Thankfully so in my opinion. However, 543 people can (just asked Florida), or 271 people (electoral colleges you know the people whose election vote actually counts are depending on the state not LEGALLY mandated to vote for the populous winner in that state.) So yeah Senator Complete-Awesomeness or whatever will not, can not, should not be able to "fix" this problem, the same goes for the Presidential office. But you know who will? You, NeutronCowboy, me, Anonymous Cowards 1,2,and 3, and enough people running for office could. We Should. We, Almighty Control-Freak in the Sky willing, will someday. I just hope for my grandchildren's sake it's not too costly and bloody of a change.

Rapid7 had just released the commercial version, dubbed Metasploit Express, of Moore's much beloved open source penetration testing tool.

How Nintendo's Mario Got His Name 103

harrymcc writes "In 1981, tiny Nintendo of America was getting ready to release Donkey Kong. When the company's landlord, Mario Segale, demanded back rent, Nintendo staffers named the game's barrel-jumping protagonist after him. Almost thirty years later, neither Nintendo — which continues to crank out Mario games — nor Segale — now a wealthy, secretive Washington State real estate developer — like to talk about how one of video games' iconic characters got his name and Italian heritage. Technologizer's Benj Edwards has researched the story for years and provides the most detailed account to date."

Wear Leveling, RAID Can Wipe Out SSD Advantage 168

storagedude writes "This article discusses using solid state disks in enterprise storage networks. A couple of problems noted by the author: wear leveling can eat up most of a drive's bandwidth and make write performance no faster than a hard drive, and using SSDs with RAID controllers brings up its own set of problems. 'Even the highest-performance RAID controllers today cannot support the IOPS of just three of the fastest SSDs. I am not talking about a disk tray; I am talking about the whole RAID controller. If you want full performance of expensive SSDs, you need to take your $50,000 or $100,000 RAID controller and not overpopulate it with too many drives. In fact, most vendors today have between 16 and 60 drives in a disk tray and you cannot even populate a whole tray. Add to this that some RAID vendor's disk trays are only designed for the performance of disk drives and you might find that you need a disk tray per SSD drive at a huge cost.'"
