GamesIndustry.biz reports that one million PlayStation 3s have been sold in the European and Australian markets. This breaks the record for Sony console sales in those sectors, as they've reached that number in only nine and half weeks. "Although released in Japan in November last year, the console has so far sold just under a million in the region, with 910,737 units sold, according to data from Media Create. The last hardware sales figures released by NPD in April showed that PS3 sales had reached over 1.3 million units in North America. According to Sony, Resistance: Fall of Man has sold 600,000 units in Europe, with MotorStorm reaching just over 500,000 sales."

The court said the U.S. Federal Communications Commission was 'arbitrary and capricious' in setting a new standard for defining indecency. 'Republican FCC Chairman Kevin Martin angrily retorted that he found it "hard to believe that the New York court would tell American families that 'sh*t' and 'f@ck' are fine to say on broadcast television during the hours when children are most likely to be in the audience ... If we can't restrict the use (of the two obscenities) during prime time, Hollywood will be able to say anything they want, whenever they want," Martin said in a statement.' No word yet on whether the agency will appeal.

GameDaily reports on new numbers from Nintendo, discussing their ongoing success with the Wii's Virtual Console offering. According to the piece, there are now over 100 games available on the service, and some 4.7 Million downloads have been transacted since the system's launch late last year. "Nintendo has been updating the Wii Shop with new Virtual Console games every Monday. The top five downloads worldwide to date have been Super Mario Bros. (NES), Super Mario 64 (N64), Mario Kart 64 (N64), Super Mario World (SNES), and The Legend of Zelda (NES). 'With an Internet connection rate reaching 40 percent, Wii owners have more options than ever to find the kinds of games they love to play,' says George Harrison, Nintendo of America's senior vice president of marketing and corporate communications. 'Beyond the Wii Shop Channel, all types of people are getting connected and checking out the information and entertainment options available on the Wii Menu. Whether voting, creating a Mii or just checking the weather, everyone has a favorite channel.'"

This will place most of the professionals in the network admin and computer security fields in a sort of legal grey area. 'The new rules tighten up the existing sanctions and prohibit any unauthorized user from disabling or circumventing computer security measures to access secure data (see the law, sections 200 and following [in German]). Manufacturing, programming, installing, or spreading software that can circumvent security measures is verboten, which means that some security scanning tools might become illegal.' We discussed a similar measure in January when Australia considered the same kind of legislation. How will this affect Linux distribution in Germany, as most standard Linux distributions come with these kind of 'hacking tools' installed by default?"

Gamasutra reports that, despite the Wii's breakaway sales success, some analysts are skeptical of the Wii's staying power. Other analysts are, of course, pointing out that many of the 'hardcore' titles are expected later this year. "[They] not[ed] that 31% of Wii owners surveyed in March said they expected to play the Wii more often a year from now, compared to 21% of Xbox 360 owners." At the same time, Nintendo of America's George Harrison is questioning the staying power of Sony and Microsoft. According to Harrison, the two larger companies 'lack the DNA' to move with the industry, and keep with the the demand for casual, more family-friendly titles. "'They're really good at reaching a certain customer, and have a real difficulty understanding how we succeed with the customers that we have,' said the senior vice president of marketing and communications. With the sales of Wii and DS hardware crushing the competition in the US, Harrison is confident that Nintendo could take up to as much as 50 per cent of the market for this latest 'next-gen' cycle."

ppadala writes "AT&T is upgrading their phone lines to offer video programmes over phone line. The service, called U-verse TV will be available in parts of Southern California communities initially. Channel lineups will be similar to traditional cable and dish offerings. AT&T is insisting that, 'This offering is on par with those of its cable rivals. But AT&T claims that it offers customers more for their money, including fast channel changing, video-on-demand, three set-top boxes, a digital video recorder, a picture-in-picture feature that allows viewers to surf channels without switching channels and an interactive program guide.'"

GamePolitics is reporting that a bill introduced just four days ago in New York's senate will soon become the law of the land. Written by Rep. Andrew Lanza, the bill's goals are extremely vague. Aiming to 'crack down on video game violence', the bill will 'establish the Advisory Council on Interactive Media and Youth Violence to review the [ESRB] rating system and its effectiveness, and recommend additional steps that can be taken to curb children's access and exposure to such adult-only material.' Unsurprisingly after drawing on public fear and a lack of education to ram through useless legislation, Lanza isn't above some gloating. "Speaking in support of his bill, Sen. Lanza apparently couldn't resist drawing on the shock value of controversial amateur game V-Tech Rampage (which he mistakenly refers to as V-Tech Massacre), even though his legislation would have no effect at all on this non-industry, non-retail, non-rated, non-professional Flash game: The recent release of 'V-Tech Massacre,' a sick game which exploits the Virginia Tech University tragedy, is a painful reminder of the culture of violence which has severe consequences on our youth and society ..." Along with Best Buy's decision to include CMA ratings on videogames, this would seem to be another harsh blow to the Entertainment Software Rating Board.

"Our planet's climate is anything but simple. All kinds of factors influence it, from massive events on the Sun to the growth of microscopic creatures in the oceans, and there are subtle interactions between many of these factors. Yet despite all the complexities, a firm and ever-growing body of evidence points to a clear picture: the world is warming, this warming is due to human activity increasing levels of greenhouse gases in the atmosphere, and if emissions continue unabated the warming will too, with increasingly serious consequences."

Skidge writes "Wired is running a piece showing the drastically reduced mileage ratings for hybrids after the upcoming changes in gas mileage calculations by the EPA. While the cars themselves aren't changing, plugging these new numbers in to the equation makes a hybrid much less cost effective: "The two top-selling hybrid vehicles, the Prius and Honda's Civic Hybrid, will lose 12 and 11 miles per gallon respectively from their city driving estimates." The new values come from more realistic testing; the old, over-inflated ratings were higher in part because the cars idled a lot, allowing the hybrids to completely turn off their engines. The new ratings should be more in line with what hybrid drivers are actually seeing."

DrBenway sends us to Ars Technica for a report that Florida and Utah have placed draconian restrictions on the sale of used music CDs; Wisconsin and Rhode Island may soon follow suit. In Florida, stores have to hold on to CDs for 30 days before they can sell them — for store credit only, not cash. Quoting: "No, you won't spend any time in jail, but you'll certainly feel like a criminal once the local record shop makes copies of all of your identifying information and even collects your fingerprints. Such is the state of affairs in Florida, which now has the dubious distinction of being so anal about the sale of used music CDs that record shops there are starting to get out of the business of dealing with used content because they don't want to pay a $10,000 bond for the 'right' to treat their customers like criminals."

Instead of regurgitating the typical reactionary voices in this debate, she looks at what scientific studies suggest about the issue. From the article: 'Pathological acts of course have multiple, complex causes and are terribly hard to predict. And clearly, millions of people play Counter-Strike, Halo, and Doom and never commit crimes. But the subtler question is whether exposure to video-game violence is one risk factor for increased aggression: Is it associated with shifts in attitudes or responses that may predispose kids to act out? A large body of evidence suggests that this may be so ... Given this, it makes sense to be specific about which games may be linked to harmful effects and which to neutral or good ones. Better research is also needed to understand whether some kids are more vulnerable to video-game violence, and how exposure interacts with other risk factors for aggression like poverty, psychological disorders, and a history of abuse.'"
