A long-simmering battle over who controls credit scoring in America has erupted into open warfare. Fair Isaac, whose FICO score is used in about 90% of consumer-lending decisions in the U.S., announced it will double the price of its mortgage credit score to $10 next year. The company also said it will bypass the three credit-reporting firms that have supplied the data feeding into its algorithm for decades.

Equifax, Experian and TransUnion created VantageScore in 2006 as an alternative to FICO and collectively own the scoring system. The move came months after Bill Pulte, head of the Federal Housing Finance Agency, announced that Fannie Mae and Freddie Mac would allow lenders to use VantageScore for mortgage approvals. The three credit-reporting firms responded by offering VantageScore free for many loans. Fair Isaac had charged a few cents per score for decades before chief executive Will Lansing began raising prices several years ago. Revenue from selling credit scores reached $920 million in fiscal 2024, nearly five times what it was a decade earlier.

AMD Amps Up Chip War - But Nvidia's Still Leading (yahoo.com) 13

The Wall Street Journal marvelled at AMD's "game-changing deal" this week with OpenAI, calling it "the culmination of an extraordinary, decade-long turnaround effort, solidifying AMD's status as Nvidia's most legitimate competitor." Shortly after taking charge of the company in 2014, [CEO] Su implemented a systematic plan to eat Intel's lunch, which she accomplished by going after Intel's main product lines while it was bogged down by manufacturing problems. Now, Su has set her sights on Nvidia, the $4.5 trillion chips behemoth led by her cousin, Jensen Huang. Some analysts believe that if Su can sign up more big customers for its AI chips, AMD could join the $1 trillion valuation club before too long.
"With this, it's natural to ask: Did AMD just say checkmate to Nvidia?" asks the Motley Fool investment site. But their answer seems to be "no"... AMD has increased its push into the AI market over the past few years, launching the AMD Instinct line of accelerators, and in the latest quarter, predicted its MI350 series would drive revenue growth in the second half of the year. Some analysts have said that AMD's innovations position it to compete with Nvidia's Blackwell architecture and chip — released late last year — but Nvidia's commitment to release upgrades on an annual basis could keep it a step ahead when it comes to overall GPU performance and therefore revenue. Big tech companies are looking for the most powerful compute available — and so far, they know they can find that at Nvidia...

[AMD's deal this week] is indeed an interesting operation, ensuring the company a major position in this infrastructure scale-up phase. [Nvidia CEO] Huang has said AI infrastructure spending may reach $4 trillion by the end of the decade, and this represents an enormous opportunity for chip designers such as AMD and Nvidia. So, the OpenAI deal is positive for AMD — but I wouldn't say it's negative for Nvidia. This chip giant signed its own deal with OpenAI last month, and it involves the deployment of 10 gigawatts of Nvidia systems across data centers...

A quick comparison of the two deals: The Nvidia-OpenAI agreement involves more gigawatts, and Nvidia isn't giving up a stake in its business — on top of this, though Nvidia is offering OpenAI funding, this will result in revenue growth as OpenAI returns to Nvidia to order GPUs. This pretty much guarantees that Nvidia will be the chip designer to benefit the most as OpenAI expands — and AMD isn't about to step ahead of the market leader. All of this means that, yes, AMD should score a win thanks to its agreement with OpenAI and this may boost its growth in the market. But the chip designer can't say "checkmate" to its bigger rival as Nvidia is perfectly positioned to maintain its lead over the long term.

DC's 'Brighter' Superman Movie Smashes Box Office Expectations (yahoo.com) 124

James Gunn's Superman "appears to be succeeding in rebooting DC Studios and its most iconic comic book franchise," writes The Hollywood Reporter, noting the film is "headed for a possible record domestic box office debut of $115 million to $120 million." Gunn is in a unique position, being both the film's writer-director and the co-head of the Warner Bros.-owned DC, which he co-runs with Peter Safran. Overseas, Superman is launching to $100 million-plus from 78 markets after earning $40 million midweek from its first raft of international markets for an early global total of $96.5 million through Friday. Superman will be the first superhero film to cross $100 million in its North American bow since Marvel Studios and Ryan Reynolds' Deadpool & Wolverine launched to $211 million in summer 2024 ("superhero fatigue" has become part of the Hollywood lexicon). And it's the first DC title to cross $100 million in eight long years since Wonder Woman debuted to $103.3 million in 2017.

And if the $225 million tentpole comes in north of $116.6 million, it will beat Zack Snyder's 2013 film Man of Steel ($116.7 million) to rank as the biggest domestic launch ever for a solo Superman pic, not adjusted for inflation. Snyder's mash-up Batman v Superman: Dawn of Justice scored the biggest DC opening of all time when earning $166.6 million over Easter weekend in 2016... Gunn's movie is only the third Hollywood title of 2025 to launch north of $100 million after fellow Warners tentpole A Minecraft Movie, which opened to $162.8 million, and Disney's live-action Lilo & Stitch, which sewed up $146 million in its debut. Crossing the century mark is no small feat for any movie in the post-pandemic era, and particularly for the troubled superhero genre.

The pic should enjoy a long run thanks to strong word-of-mouth. Critics and audiences alike are embracing the film. The pic earned an A- CinemaScore from moviegoers, the same grade given to Man of Steel and ahead of Superman Returns' B+. The audience score on Rotten Tomatoes is a stellar 94 percent, while the critics' score is a pleasing 82 percent...

Other upcoming DC Studios projects include HBO's Green Lantern series, Lanterns, and a Supergirl movie due out in 2026.

Superman's weekend debut at nearly $130 million domestically smashes early estimates of around $90 million (according to a senior media analyst at Comscore).

And the film also got a positive reaction from the author of the cultural history Superman: The Unauthorized Biography (writing for NPR): Recent attempts to tell live-action Superman stories have shied away from his bright, hopeful, altruistic nature in favor of making him more cool and relatable (read: dark and brooding). That's not who he is; it never has been. Superman is an ideal. He represents the best we can aspire to be. He's not the hero you relate to, à la Peter Parker/Spider-Man's ongoing struggle to pay his rent and buy Aunt May her damn medicine. He's the hero who inspires you, who shows you the way...

It doesn't have to be about slogging through trauma and shame and shadow-selves and endlessly tedious redemption arcs. Sometimes, it's simpler, cleaner, brighter. And also? Not for nothing? More fun.

VMware Perpetual License Holder Receives Audit Letter From Broadcom (arstechnica.com) 82

An anonymous reader quotes a report from Ars Technica: After sending cease-and-desist letters to VMware users whose support contracts had expired and who subsequently declined to subscribe to one of Broadcom's VMware bundles, Broadcom has started the process of conducting audits on former VMware customers. [...] Ars Technica reviewed a letter that a software provider and VMware user in the Netherlands received that is dated June 20 and informs the firm that it "has been selected for a formal audit of its use of VMware software and support services" [PDF]. The security professional who provided Ars with the letter asked to keep their name and their employers' name anonymous out of privacy concerns.

The anonymous employee told Ars that their company had been a VMware customer for "about" a decade before deciding not to sign up for a new contract with Broadcom's VMware a year ago. The company had been using VMware Cloud Foundation and vSphere. "Our CEO decided to not extend the support contract because of the costs," the employee said. "This already impacts us security-wise because we can no longer get updates (unless the CVSS score is critical)." The letter notes that an auditing firm, Connor Consulting, which is headquartered in San Francisco and has offices around the globe, will perform a review of the company's "VMware deployment and entitlements, which may include fieldwork or remote testing and meetings with members of your accounting, licensing, and management information systems functions." The letter informs its recipient that someone from Connor will reach out and that the VMware user should respond within three business days.

The letter, signed by Aiden Fitzgerald, director of global sales operations at Broadcom, claims that Broadcom will use its time "as efficiently and productively as possible to minimize disruption." Still, the security worker that Ars spoke with is concerned about the implications of the audit and said they "expect a big financial impact" for their employer. They added: "Because we are focusing on saving costs and are on a pretty tight financial budget, this will likely have impact on the salary negotiations or even layoffs of employees. Currently, we have some very stressed IT managers [and] legal department [employees] ..." The employee noted that they are unsure if their employer exceeded its license limits. If the firm did, it could face "big" financial repercussions, the worker noted.

America Has Biggest Three-Day Weekend Box Office Ever (variety.com) 47

It's America's biggest box office for a Memorial Day weekend ever, reports Variety.

And it's been more than a decade since this many Americans went to see a movie during a three-day weekend... Families turned out in force for Disney's live-action "Lilo & Stitch" remake, which collected a blockbuster $145.5 million in its opening weekend and an estimated $183 million through Monday... Meanwhile, older audiences showed up to watch Paramount and Skydance's "Mission: Impossible — The Final Reckoning," which earned a series-best $63 million over the weekend and an estimated $77 million through Monday's holiday. This eighth installment just narrowly beat 2018's "Mission: Impossible — Fallout" ($61 million) to score the top debut of the 29-year-old franchise...

Thanks to effective counterprogramming — and a huge assist by holdovers like "Final Destination Bloodlines," "Thunderbolts*" and "Sinners" — this weekend delivered the best collective Memorial Day weekend haul with $322 million... Cinema operators are rejoicing because Memorial Day is the official launch to summer movie season, which is the most profitable stretch for the movie business. (Historically, the four-month period has accounted for $4 billion, or around 40% of the annual box office.)

It's a huge improvement from last year, which started with a whimper rather than a bang as "Furiosa: A Mad Max Saga" and "Garfield" led the holiday's worst showing in three decades with $132 million collectively. "Every film on the release calendar for the rest of the summer is going to benefit from the momentum created over this monumental record-breaking Memorial weekend in theaters," says senior Comscore analyst Paul Dergarabedian.

But the top-earning movie of the year so far is A Minecraft Movie, which has apparently brought in over $940 million.

Meanwhile, Mission Impossible: The Final Reckoning is one of the most expensive films of all time, according to the article, costing $400 million as Tom Cruise and the movie's director "worked through a pandemic and two strikes, all while grappling with inflation." Though the film received a high "A-" grade on CinemaScore, a movie industry analyst tells Variety that the unexpectedly high production costs means the movie "will be lucky to break-even."

Fun fact: A quarter of a century ago, CmdrTaco reviewed a new movie called Mission: Impossible 2, calling it "a fun movie," but "no Gladiator" and sort of a "James Bond for Dummies" movie.

"Google-owned YouTube's revenue last year was estimated to be $54.2 billion," reports the Los Angeles Times, "which would make it the second-largest media company behind Walt Disney Co., according to a recent report from research firm MoffettNathanson, which called YouTube 'the new king of all media.'" YouTube, run by Chief Executive Neal Mohan since 2023, accounted for 12% of U.S. TV viewing in March, more than other rival streaming platforms including Netflix and Tubi, according to Nielsen... More people are watching YouTube on TV sets rather than on smartphones and computer screens, consuming more than 1 billion hours on average of YouTube content on TV daily, the company said on its website.
When YouTube first started its founders envisioned it as a dating site, according to the article, "where people would upload videos and score them. When that didn't work, the founders decided to open up the platform for all sorts of videos." And since this was 20 years ago, "Users drove traffic to YouTube by sharing videos on MySpace."

But the article includes stories of people getting rich through YouTube's sharing of ad revenue: Patrick Starrr, who produces makeup tutorial videos, said he made his first $1 million through YouTube at the age of 25. He left his job at retailer MAC Cosmetics in Florida and moved to L.A...

[Video creator Dhar Mann] started posting videos on YouTube in 2018 with no film background. Mann previously had a business that sold supplies to grow weed. Today, his company, Burbank-based Dhar Mann Studios, operates on 125,000 square feet of production space, employs roughly 200 people and works with 2,000 actors a year on family friendly programs that touch on how students and families deal with topics such as bullying, narcolepsy, chronic inflammatory bowel disease and hoarding. Mann made $45 million last year, according to Forbes estimates. The majority of his company's revenue comes through YouTube.

He tells the Times "I don't think it's just the future of TV — it is TV, and the world is catching on."

And then there's this... "My mom would always give me so much crap about it — she would say, 'Why do you want to do YouTube?'" said Chucky Appleby, now an executive at MrBeast. His reply: "Mom, you can make a living from this." MrBeast's holding company, Beast Industries, which employs more than 400 people, made $473 million in revenue last year, according to Business Insider. In the last 28 days, MrBeast content — which includes challenges and stunt videos — received 3.6 billion views on YouTube, Appleby said.

Appleby, 28, said he's since bought a Jeep for his mom.

In 'Milestone' for Open Source, Meta Releases New Benchmark-Beating Llama 4 Models (meta.com) 65

It's "a milestone for Meta AI and for open source," Mark Zuckerberg said this weekend. "For the first time, the best small, mid-size, and potentially soon frontier [large-language] models will be open source."

Zuckerberg anounced four new Llama LLMs in a video posted on Instagram and Facebook — two dropping this weekend, with another two on the way. "Our goal is to build the world's leading AI, open source it, and make it universally accessible so that everyone in the world benefits."

Zuckerberg's announcement: I've said for a while that I think open source AI is going to become the leading models. And with Llama 4 this is starting to happen.

- The first model is Llama 4 Scout. It is extremely fast, natively multi-modal. It has an industry-leading "nearly infinite" 10M-token context length, and is designed to run on a single GPU. [Meta's blog post says it fits on an NVIDIA H100]. It is 17 billion parameters by 16 experts, and it is by far the highest performing small model in its class.

- The second model is Llama 4 Maverick — the workhorse. It beats GPT-4o and Gemini Flash 2 on all benchmarks. It is smaller and more efficient than DeepSeek v3, but it is still comparable on text, plus it is natively multi-modal. This one is 17B parameters x 128 experts, and it is designed to run on a single host for easy inference.

This thing is a beast.

Zuck promised more news next month on "Llama 4 Reasoning" — but the fourth model will be called Llama 4 Behemoth. "This thing is massive. More than 2 trillion parameters." (A blog post from Meta AI says it also has a 288 billion active parameter model, outperforms GPT-4.5, Claude Sonnet 3.7, and Gemini 2.0 Pro on STEM benchmarks, and will "serve as a teacher for our new models.")

"I'm not aware of anyone training a larger model out there," Zuckberg says in his video, calling Behemoth "already the highest performing base model in the world, and it is not even done training yet."

"If you want to try Llama 4, you can use Meta AI in WhatsApp, Messenger, or Instagram Direct," Zuckberg said in his video, "or you can go to our web site at meta.ai." The Scout and Maverick models can be downloaded from llama.com and Hugging Face.

Texas Sues Allstate For Collecting Driver Data To Raise Premiums (gizmodo.com) 62

An anonymous reader quotes a report from Gizmodo: Texas has sued (PDF) one of the nation's largest car insurance providers alleging that it violated the state's privacy laws by surreptitiously collecting detailed location data on millions of drivers and using that information to justify raising insurance premiums. The state's attorney general, Ken Paxton, said the lawsuit against Allstate and its subsidiary Arity is the first enforcement action ever filed by a state attorney general to enforce a data privacy law. It also follows a deceptive business practice lawsuit he filed against General Motors accusing the car manufacturer of misleading customers by collecting and selling driver data.

In 2015, Allstate developed the Arity Driving Engine software development kit (SDK), a package of code that the company allegedly paid mobile app developers to install in their products in order to collect a variety of sensitive data from consumers' phones. The SDK gathered phone geolocation data, accelerometer, and gyroscopic data, details about where phone owners started and ended their trips, and information about "driving behavior," such as whether phone owners appeared to be speeding or driving while distracted, according to the lawsuit. The apps that installed the SDK included GasBuddy, Fuel Rewards, and Life360, a popular family monitoring app, according to the lawsuit.

Paxton's complaint said that Allstate and Arity used the data collected by its SDK to develop and sell products to other insurers like Drivesight, an algorithmic model that assigned a driving risk score to individuals, and ArityIQ, which allowed other insurers to "[a]ccess actual driving behavior collected from mobile phones and connected vehicles to use at time of quote to more precisely price nearly any driver." Allstate and Arity marketed the products as providing "driver behavior" data but because the information was collected via mobile phones the companies had no way of determining whether the owner was actually driving, according to the lawsuit. "For example, if a person was a passenger in a bus, a taxi, or in a friend's car, and that vehicle's driver sped, hard braked, or made a sharp turn, Defendants would conclude that the passenger, not the actual driver, engaged in 'bad' driving behavior," the suit states. Neither Allstate and Arity nor the app developers properly informed customers in their privacy policies about what data the SDK was collecting or how it would be used, according to the lawsuit.
The lawsuit violates Texas' Data Privacy and Security Act (DPSA) and insurance code by failing to address violations within the required 30-day cure period. "In its complaint, filed in federal court, Texas requested that Allstate be ordered to pay a penalty of $7,500 per violation of the state's data privacy law and $10,000 per violation of the state's insurance code, which would likely amount to millions of dollars given the number of consumers allegedly affected," adds the report.

"The lawsuit also asks the court to make Allstate delete all the data it obtained through actions that allegedly violated the privacy law and to make full restitution to customers harmed by the companies' actions."

Even Password Manager Subscribers Reuse Passwords, Study Finds (pcmag.com) 61

An anonymous reader shares a report: It's not exactly breaking news that people reuse passwords, but you might expect password manager subscribers to avoid the practice. You'd be wrong, according to a new study. Dashlane's downer of a report draws on saved logins analyzed on-device by Dashlane's software across "millions" of individual and business accounts. It finds dismally high percentages of password reuse worldwide. The US and Canada rank the worst of every region Dashlane tracked, with 48% of passwords in individual password vaults being reused. Another 15% rate as compromised, meaning those passwords have shown up in data breaches.

Combined with other security data points, the US and Canada land at a security score of 72.6 out of 100 in Dashlane's report, the lowest of all 14 regions covered in the study. The report, along with the Password Health score that Dashlane's software computes for individual users, emphasizes the longstanding problem of password reuse because that practice leaves its practitioners so vulnerable to getting hacked.Â

Rotten Tomatoes Introduces a New Audience Rating For People Who Actually Bought a Ticket (indiewire.com) 48

Rotten Tomatoes and Fandango are rolling out a new "Verified Hot" rating for users who actually bought a ticket to the movie being reviewed. "The designation is only given to theatrical movies that have reached an audience score above 90 percent among user ratings," adds IndieWire. From the report: Movie ticketing app Fandango is the parent company to Rotten Tomatoes, so if you bought your ticket through Fandango and then rated a movie using that same user info on Rotten Tomatoes, RT is able to confirm you bought a ticket and can filter out anyone else who may just be rating things blindly. A rep for RT tells IndieWire the goal is to work with other partners so that other people who don't use Fandango can still be considered verified.

Rotten Tomatoes also expanded its Popcornmeter designations. Anything with an audience score above 60 percent of people rating it as 3.5 stars or higher will be labeled "Hot," and movies below that 60 percent threshold are now "Stale." The "Certified Fresh" badge for movies that achieve a strong enough critics score has been around for a while, but in 2020 RT introduced a "Top Critics" feature such that you could filter out the dozens or hundreds of aggregated critics from unreliable sources who could be skewing a film's score. Anyone can vote or rate movies on Rotten Tomatoes if you're an audience member, but you can also filter out ratings from those not considered "verified."

Rotten Tomatoes made some other tweaks too under the hood: Both the Popcornmeter and Tomatometer need to meet a new minimum number of reviews published for a score to appear. Not everything gets reviewed widely, so the threshold varies depending on a film's total projected domestic box office forecast.

Parents Rage Against New Fee To Keep Their Smart Bassinets Smart (nytimes.com) 91

Smonster writes: The maker of the Snoo, a popular high-tech bassinet, touched off a firestorm of outrage after requiring a paid subscription to use several key features. Most new parents are looking for a way to reclaim even a hint of the sleep they used to get pre-infant. So a smart bassinet that uses sensors to detect when a crying baby needs pacifying, simulating the sounds and rhythms of the womb, offers an irresistible promise to sleep-strapped parents: another hour or two of shut-eye. The dream doesn't come cheap: One of the more popular models, the Snoo retails for $1,700, though enterprising parents can score one secondhand from friends, neighbors or relatives whose own children have outgrown it.

But last month, that hand-me-down network was dealt a blow when Happiest Baby, the company that makes Snoo, began charging for access to some of the bassinet's premium features -- features that used to be available to Snoo users indefinitely, at no extra cost. Now, access to the app needed to lock in the bassinet's rocking level, to track the baby's sleep and to use the so-called weaning mode, among other features, will cost parents $20 a month. The change has angered secondhand users and original buyers alike. On Reddit, the new subscription model has prompted review bombs, group brainstorms for collective action and detailed instructions for outraged parents seeking recourse. Some have taken to filing complaints with the Federal Trade Commission, Better Business Bureau and state-run consumer protection offices.

It Is Now Easier To Pass AP Tests (msn.com) 42

More students are getting high scores on Advanced Placement tests, long seen as a gateway to elite college admissions as well as a way to earn college credit during high school. From a report: Changes by the tests' maker in recent years have shifted scores upward. That has led to hundreds of thousands of additional students getting what's considered a passing score -- 3 or above on the 1-to-5 scale -- on exams in popular courses including AP U.S. History and AP U.S. Government.

The nonprofit behind the tests, College Board, says it updated the scoring by replacing its panel of experts with a large-scale data analysis to better reflect the skills students learn in the courses. Some skeptical teachers, test-prep companies and college administrators see the recent changes as another form of grade inflation, and a way to boost the organization's business by making AP courses seem more attractive.

"It is hard to argue with the premise of AP, that students who are talented and academically accomplished can get a head start on college," said Jon Boeckenstedt, the vice provost of enrollment at Oregon State University. "But I think it's a business move." The number of students cheering their higher AP scores could rise again next year. The College Board said it is still recalibrating several other subjects, including its most popular course, AP English Language, which attracts more than half a million test takers.

New Research Finds America's EV Chargers Are Just 78% Reliable (and Underfunded) (hbs.edu) 220

Harvard Business School has an "Institute for Business in Global Society" that explores the societal impacts of business. And they've recently published some new AI-powered research about EV charging infrastructure, according to the Institute's blog, conducted by climate fellow Omar Asensio.

"Asensio and his team, supported by Microsoft and National Science Foundation awards, spent years building models and training AI tools to extract insights and make predictions," using the reviews drivers left (in more than 72 languages) on the smartphone apps drivers use to pay for charging. And ultimately this research identified "a significant obstacle to increasing electric vehicle (EV) sales and decreasing carbon emissions in the United States: owners' deep frustration with the state of charging infrastructure, including unreliability, erratic pricing, and lack of charging locations..." [C]harging stations in the U.S. have an average reliability score of only 78%, meaning that about one in five don't work. They are, on average, less reliable than regular gas stations, Asensio said. "Imagine if you go to a traditional gas station and two out of 10 times the pumps are out of order," he said. "Consumers would revolt...." EV drivers often find broken equipment, making charging unreliable at best and simply not as easy as the old way of topping off a tank of gas. The reason? "No one's maintaining these stations," Asensio said.
One problem? Another blog post by the Institute notes that America's approach to public charging has differed sharply from those in other countries: In Europe and Asia, governments started making major investments in public charging infrastructure years ago. In America, the initial thinking was that private companies would fill the public's need by spending money to install charging stations at hotels, shopping malls and other public venues. But that decentralized approach failed to meet demand and the Biden administration is now investing heavily to grow the charging network and facilitate EV sales... "No single market actor has sufficient incentive to build out a national charging network at a pace that meets our climate goals," the report declared. Citing research and the experience of other countries, it noted that "policies that increase access to charging stations may be among the best policies to increase EV sales." But the U.S. is far behind other countries.

Professors Are Now Using AI to Grade Essays. Are There Ethical Concerns? (cnn.com) 102

A professor at Ithaca College runs part of each student's essay through ChatGPT, "asking the AI tool to critique and suggest how to improve the work," reports CNN. (The professor said "The best way to look at AI for grading is as a teaching assistant or research assistant who might do a first pass ... and it does a pretty good job at that.")

And the same professor then requires their class of 15 students to run their draft through ChatGPT to see where they can make improvements, according to the article: Both teachers and students are using the new technology. A report by strategy consultant firm Tyton Partners, sponsored by plagiarismâdetection platform Turnitin, found half of college students used AI tools in Fall 2023. Meanwhile, while fewer faculty members used AI, the percentage grew to 22% of faculty members in the fall of 2023, up from 9% in spring 2023.

Teachers are turning to AI tools and platforms — such as ChatGPT, Writable, Grammarly and EssayGrader — to assist with grading papers, writing feedback, developing lesson plans and creating assignments. They're also using the burgeoning tools to create quizzes, polls, videos and interactives to up the ante" for what's expected in the classroom. Students, on the other hand, are leaning on tools such as ChatGPT and Microsoft CoPilot — which is built into Word, PowerPoint and other products.

But while some schools have formed policies on how students can or can't use AI for schoolwork, many do not have guidelines for teachers. The practice of using AI for writing feedback or grading assignments also raises ethical considerations. And parents and students who are already spending hundreds of thousands of dollars on tuition may wonder if an endless feedback loop of AI-generated and AI-graded content in college is worth the time and money.

A professor of business ethics at the University ofâVirginia "suggested teachers use AI to look at certain metrics — such as structure, language use and grammar — and give a numerical score on those figures," according to the article. ("But teachers should then grade students' work themselves when looking for novelty, creativity and depth of insight.")

But a writer's workshop teacher at the University of Lynchburg in Virginia "also sees uploading a student's work to ChatGPT as a 'huge ethical consideration' and potentially a breach of their intellectual property. AI tools like ChatGPT use such entries to train their algorithms..."

Even the Ithaca professor acknowledged to CNN that "If teachers use it solely to grade, and the students are using it solely to produce a final product, it's not going to work."

WSJ: 'America Made a Huge Bet On Sports Gambling. The Backlash Is Here' (msn.com) 75

In 2018 the U.S. Supreme Court overturned the outlawing of sports betting in America.

But the Wall Street Journal reports that since then all the major professional sports bodies "now realize just how much they have to lose as the new era unfolds." "All it takes is for a reasonable fan to go, 'Am I just watching theater, or is this actually sport?' for the credibility of a sport to start crumbling,'" said Declan Hill, an expert on match fixing at the University of New Haven.

Since the prohibition on sports gambling was lifted, leagues that had once viewed betting as an existential threat to their integrity scrambled to partner with gambling companies and brought them into the tent.... The NBA itself also announced a new feature designed to mesh the betting experience with live action: Fans watching games on League Pass, the flagship streaming platform, would be able to opt in to view betting odds on the app's interface and click through to place wagers... Cleveland Cavaliers head coach J.B. Bickerstaff said that gambling had "gone too far... I personally have had my own instances with some of the sports gamblers," he added, "where they got my telephone number, were sending me crazy messages about where I live, and my kids and all that stuff."

NBA spokesman Mike Bass said that instances of reported harassment related to sports betting are investigated. Then, just days after Haliburton and Bickerstaff's complaints, the NBA found itself grappling with a new case... The league is investigating suspicious activity around [Toronto Raptors forward Jontay] Porter, after app users placed sizable wagers that his totals for points, rebounds and assists in a pair of games would all come in under the lines set by oddsmakers. When Porter's numbers fell below those marks and the bets paid out, it raised a red flag signaling possible irregularities....

The NCAA has turned to state legislatures to impose regulations that would take single players out of gamblers' crosshairs. The group is lobbying to ban player-specific proposition bets that aren't directly related to the final score of the game — the exact kind of wagers at the center of the Porter situation in the NBA

After noticing "the gambling-related negativity taking over his social-media feeds," pro basketball player Tyrese Haliburton gave the Journal his own assessment of how it's affecting the fan base.

"To half the world, I'm just helping them make money on DraftKings."

Billy Mitchell and Twin Galaxies Settle Lawsuits On Donkey Kong World Records (nme.com) 64

"What happens when a loser who needs to win faces a winner who refuses to lose?"

That was the tagline for the iconic 2007 documentary The King of Kong: A Fistful of Quarters, chronicling a middle-school teacher's attempts to take the Donkey Kong record from reigning world champion Billy Mitchell. "Billy Mitchell always has a plan," says Billy Mitchell in the movie (who is also shown answering his phone, "World Record Headquarters. Can I help you?") By 1985, 30-year-old Mitchell was already listed in the "Guinness Book of World Records" for having the world's highest scores for Pac-Man, Ms. Pac-Man, Donkey Kong, Donkey Kong, Jr., Centipede, and Burger Time.

But then, NME reports... In 2018, a number of Mitchell's Donkey Kong high-scores were called into question by a fellow gamer, who supplied a string of evidence on the Twin Galaxies forums suggesting Mitchell had used an emulator to break the records, rather than the official, unmodified hardware that's typically required to keep things fair. [Twin Galaxies is Guiness World Records' official source for videogame scores.] Following "an independent investigation," Mitchell's hi-scores were removed from video game database Twin Galaxies as well as the Guinness Book Of Records, though the latter reversed the decision in 2020. Forensic analysts also accused him of cheating in 2022 but Mitchell has fought the accusations ever since.
This week, 58-year-old Billy Mitchell posted an announcement on X. "Twin Galaxies has reinstated all of my world records from my videogame career... I am relieved and satisfied to reach this resolution after an almost six-year ordeal and look forward to pursuing my unfinished business elsewhere. Never Surrender, Billy Mitchell."

X then wrote below the announcement, "Readers added context they thought people might want to know... Twin Galaxies has only reinstated Michell's scores on an archived leaderboard, where rules were different prior to TG being acquired in 2014. His score remains removed from the current leaderboard where he continues to be ineligible by today's rules."

The statement from Twin Galaxies says they'd originally believed they'd seen "a demonstrated impossibility of original, unmodified Donkey Kong arcade hardware" in a recording of one of Billy's games. As punishment they'd then invalidated every record he'd ever set in his life.

But now an engineer (qualified as an expert in federal courts) says aging components in the game board could've produced the same visual artifacts seen in the videotape of the disputed game. Consistent with Twin Galaxies' dedication to the meticulous documentation and preservation of video game score history, Twin Galaxies shall heretofore reinstate all of Mr. Mitchell's scores as part of the official historical database on Twin Galaxies' website. Additionally, upon closing of the matter, Twin Galaxies shall permanently archive and remove from online display the dispute thread... as well as all related statements and articles.
NME adds: Twin Galaxies' lawyer David Tashroudian told Ars Technica that the company had all its "ducks in a row" for a legal battle with Mitchell but "there were going to be an inordinate amount of costs involved, and both parties were facing a lot of uncertainty at trial, and they wanted to get the matter settled on their own terms."
And the New York Times points out that while Billy scored 1,062,800 in that long-ago game, "The vigorous long-running and sometimes bitter dispute was over marks that have long since been surpassed. The current record, as reported by Twin Galaxies, belongs to Robbie Lakeman. It's 1,272,800."

CEO Reminds Everyone His Company Collects Customers' Sleep Data (404media.co) 46

An anonymous reader quotes a report from 404 Media: Matteo Franceschetti, the CEO of Eight Sleep, which makes the $2,295 smart mattress topper "The Pod" tweeted: "Breaking news: The OpenAI drama is real. We checked our data and last night, SF saw a spike in low-quality sleep. There was a 27 percent increase in people getting under 5 hours of sleep. We need to fix this. Source: @eightsleep data." Franceschetti's tweet reminds us that The Pod is essentially a mattress with both a privacy policy and a terms of service, and that the data Eight Sleep collects about its users can and is used to further its business goals. It's also a reminder that many apps, smart devices, and apps for smart devices collect a huge amount of user data that they can then directly monetize or deploy for marketing or Twitter virality purposes whenever they feel like it.

The Pod does "intelligent cooling and heating for any bed," and learns and adjusts the temperature of the bed based on your sleep habits, tracks your sleep and vital signs while you sleep, and gives you a "Sleep Fitness Score" based on your quality, routine, and time of sleep. As someone who often does not sleep well, The Pod is a compelling product that I cannot currently afford. Quickly, to get it out of the way: Eight Sleep's data does not and cannot actually show that "San Francisco" had a spike in low-quality sleep. What it shows is that people in San Francisco who have purchased a $2,295 smart mattress topper and have not successfully opted out of Eight Sleep's analytics -- a group that surely overindexes on tech workers -- slept less Sunday night.

The top of Eight Sleep's terms of service states "At Eight Sleep we pledge to respect your privacy and to keep your data safe. We only collect data that helps us improve our products and services." Both Eight Sleep's privacy policy and terms of service then go on to note that the company collects a huge amount of data that can be used for a wide variety of purposes, including marketing, retargeting, and scientific studies. It can also, apparently, be used by the CEO for commenting on the day's tech news. Specifically, the company notes that "data about your sleep activity is transferred from your Device to our servers" every time the Pod's app syncs with the Pod. Certain features on the device also require location data "including GPS signals, device sensors, Wi-Fi access points, and cell tower IDs." This data is then used to give users personalized sleep recommendations, but they are also "used in research to understand and improve the Eight Device and Eight Service," "to enforce the Eight Terms of Service," and, critically, "de-identified data that does not identify you may be used to inform the health and scientific community about trends; for marketing and promotional use; or for sale to interested audiences." The terms of service add that it "may share or sell" this data.

UK Opposition Leader Targeted By AI-Generated Fake Audio Smear (therecord.media) 49

An anonymous reader quotes a report from The Record: An audio clip posted to social media on Sunday, purporting to show Britain's opposition leader Keir Starmer verbally abusing his staff, has been debunked as being AI-generated by private-sector and British government analysis. The audio of Keir Starmer was posted on X (formerly Twitter) by a pseudonymous account on Sunday morning, the opening day of the Labour Party conference in Liverpool. The account asserted that the clip, which has now been viewed more than 1.4 million times, was genuine, and that its authenticity had been corroborated by a sound engineer.

Ben Colman, the co-founder and CEO of Reality Defender -- a deepfake detection business -- disputed this assessment when contacted by Recorded Future News: "We found the audio to be 75% likely manipulated based on a copy of a copy that's been going around (a transcoding). As we don't have the ground truth, we give a probability score (in this case 75%) and never a definitive score ('this is fake' or 'this is real'), leaning much more towards 'this is likely manipulated' than not," said Colman. "It is also our opinion that the creator of this file added background noise to attempt evasion of detection, but our system accounts for this as well," he said.

SUSE To Flip Back Into Private Ownership (theregister.com) 17

Two years after being listed on the Frankfurt Stock Exchange, the Linux-for-enterprise company SUSE is switching back to private ownership. The Register reports: On Wednesday the developer announced that its majority shareholder, an entity called Marcel LUX III SARL, intends to take it private by delisting it from the Frankfurt Stock Exchange and merging it with an unlisted Luxembourg entity. Marcel is an entity controlled by EQT Private Equity, a Swedish investment firm, which acquired it from MicroFocus in 2018.

The announcement offers scant detail about the rationale for the delisting, other than a canned quote from SUSE CEO Dirk-Peter van Leeuwen who said, "I believe in the strategic opportunity of taking the company private -- it gives us the right setting to grow the business and deliver on our strategy with the new leadership team in place." Van Leeuwen took the big chair at SUSE just over three months back, on May 1. The deal values SUSE at 16 euros per share -- well below the 30-euro price of the 2021 float, but above the Thursday closing price of 9.605 euros.

Interestingly, Marcel is happy for shareholders not to take the money and run. "There is no obligation for shareholders to accept the Offer," explains the announcement's detail of the transaction's structure. "EQT Private Equity does not intend to pursue a squeeze-out. Therefore, shareholders who wish to stay invested in SUSE in a private setting may do so." Shareholders who stick around will therefore score their portion of a special dividend SUSE will pay out as part of this transaction. Those who sell will get the aforementioned 16-euros per share, less their portion of the interim dividend. The transaction to take SUSE private is expected to conclude in the final quarter of 2023.
