Rob Tiller, vice president and general counsel for Red Hat, details a recent court ruling on this very matter—one that has critical implications for the future of software patents, and one that divided the judges involved. Tiller writes that:

The judges mostly agreed that the idea of managing settlement risk with a third party was abstract such that by itself it could not be patented. They differed, though, on whether using a general purpose computer for managing settlement risk meant that the patents avoided invalidity based on abstraction.

Interestingly, some judges suggested that a computer becomes a "new machine" every time it loads different software. Opensource.com has Tiller's complete analysis.

arjay-tea writes: Drag racing would be really interesting again if there were an all-electric class of racers. The prospect of seeing rapid evolution of an important technology in a competition setting is a refreshing change from the minor tweaks and refinements of the usual combustion engine cars. Of course some new rules would be required. One might be that vehicles must be disconnected from any power source for at least an hour prior to the start. There might be two classes based on whether capacitors are allowed or not, etc. What do you think?

80% of the job is not dependant on code technologies in most shops.. Its tasks that have been the same throughout time at every development shop 1. Understanding the problem at Hand. Reading and clarifying the spec, delivering a timeline that can be achieved. 2. Simplifying the problem into Component Parts that can be completed with minimal effort along acceptable timeline. Reuse what might already be sitting there in the libraries and open source world. 3. Selection of the tool set to quickest solve the problem/build the component code. 4. Testing, Testing and Testing and then declaring it ready for testing in front of the client. 5. Deliver of Product on Time and at Budget, with comments and documented and supportable. Teaching younger staff to do these things regardless of what framework, language used and tempest in a teacup office politics that are going on is handy for just about any project. The Good to better Greybeards have seen it all.... nothing is new... technology is now faster and cheaper but man hours are more expensive than ever, They also typically enjoy the client meeting than the fresh code guns.

Battery technology has been a slow evolution and after 200 hundred years quantum leaps of performance are most expensive. The free market is working on this one, any money thrown at this just makes the market less free and less level. Wish the DOE would work on a standard "US Nuclear Power plant" design for the 21st century so all these batteries can be charged with the cheapest power possible on actual cost and pollution products basis.

At this point it is just a matter of how much you are willing to spend with 10Gig Ethernet becoming the standard method for handoff from the Telco demark. Just installed a L3 endpoint with well over 50Gig/sec of capacity with each gig/sec CIR costing less than it takes my company to write the check and split it out to the customers invoices. Storage and Power/Cooling are the last expensive item in the datacenter.

2 x CONSOLE SERVERS to everything.
2 x CONFIG SERVERS, IOS, DOCUMENTATION STORES TFTP FTP SFTP
2 x SECURITY SERVERS THAT LET YOU IN THE DOOR
n x HVAC, POWER MONITORING, GENSET TOOLS.
2 x SYSLOG SERVER with local HHD.
2 x JUMPBOX with REAL OUT OF BAND BANDWIDTH (CABLE MODEM, CELL MODEM, VT100 in office space....sucks to work in a dark HOT DC)
1 x TIMECLOCK with cardstock because this is going to take a while.


All should have the least number of transfer switches(evil beasts) and should be at the base of the A and B sides of the Power Plan.

16 Trillion reasons not to spend more than keeping life support on for NASA. When there are less than 50% of US citizens are dependent on some type of federal aid to keep above bankruptcy it might be time to go to the moon. And when college students can afford to pay tuition from the earnings of part time job and not finance the basic education until there retirement perhaps mars would be in reach of American Astronauts. We will need to go backwards for a bit to rebuild ourselves.

Google by building a farm in tornado central and hiring engineers their is showing either ignorance of modern cable super head ends to take content feeds from the content providers.

Google does not need to build this next to the data center for distribution of live stream content. It can be rented in very fast order from L3 with multiple farms or be put on multiple network carriers with what is now a low end DIA at 100mbit/sec.
Super head ends are all satellite Feed de-encryption and IPv4 multicast converters and are not very sexy places these days...2-6 NEXUS 7K/6513Es and a whole bunch of Scitific Alantic (now Cisco) gear. The largest linups are less than 20-30gig/sec in total. (15mbit/sec is high even for combined HD/SD streams at highest rates for all but major network sports). They would be really smart to put all the commercial insets, EBS, VOD ingest in the cloud infrastructure in existing DCs if they want to recast how to distribute live streams to TVset/settops

It is also possible this is entirely for only VOD injest to their content servers as this is the industry standard way to multicast a stream to clients media servers by the providers and networks. It has been a very cheap way to get 500Gig of VOD files to 40-2000 clients without paying for wireline bandwidth. Send everything you got broadcast...think multicast... off a bird and just send out the keys to lic the content on the VOD servers.

VZ, L3, AT&T, Comcast, and any number of smaller players like Frontier Communications could all provide these services tomorrow for a fee off dishes that they already pay for. And proably would be good choices as backup sites to kanas as you need at least 2 farm locations separated by geographic bands caused by solar and weather interference issues. The more forward thinking content networks could also provide a circuit or MPLS based feed direct to a couple of Googles DCs and bypass all needs for the Satellite sharks involvement in the path for streams of network content.

Simple solution for carriers. Do the right thing and provide PICOcell (to Broadband) or Repeaters at zero cost and control the equipment. Instead of litigation, spend some time to develeop a single chassie, E911 (dGPS), software radio, 30 day UPSed, solution and send a text invite to everyone who has a single bar at the same address they get their bill sent to. Now if they were real smart they could add WiMax and WiFi and make every one of these points where customers could opt in for additional services.
