Most "hidden tracks" would be in violation as well. However, in this particular case, Tool would have a better chance of winning the lawsuit, as their album Undertow includes 59 1-second tracks of silence between the 9th song and Disgustipated, which opens with one second of silence. And yes, the vinyl and CD both have the gaps removed.
