Recent theories have emerged that previous attempts at identifying organic compounds in Martian soil may have actually cooked away any signs of life-giving elements. SONY BMG Music Entertainment was dismissed at the District Court level, the antitrust class action against the RIAA has been reinstated by the US Court of Appeals for the Second Circuit. In its 25-page opinion (PDF), the Appeals court held the following allegations sufficiently allege antitrust violations: 'First, defendants agreed to launch MusicNet and pressplay, both of which charged unreasonably high prices and contained similar DRMs. Second, none of the defendants dramatically reduced their prices for Internet Music (as compared to CDs), despite the fact that all defendants experienced dramatic cost reductions in producing Internet Music. Third, when defendants began to sell Internet Music through entities they did not own or control, they maintained the same unreasonably high prices and DRMs as MusicNet itself. Fourth, defendants used MFNs [most favored nation clauses] in their licenses that had the effect of guaranteeing that the licensor who signed the MFN received terms no less favorable than terms offered to other licensors. For example, both EMI and UMG used MFN clauses in their licensing agreements with MusicNet. Fifth, defendants used the MFNs to enforce a wholesale price floor of about 70 cents per song. Sixth, all defendants refuse to do business with eMusic, the #2 Internet Music retailer. Seventh, in or about May 2005, all defendants raised wholesale prices from about $0.65 per song to $0.70 per song. This price increase was enforced by MFNs.'"

The original was in visible light; this version, five years on, is in infrared (1.05, 1.25 and 1.6 um). The observation is in support of the upcoming JWST, which will observe exclusively in infrared, but the newly installed WFC3 does seem to provide some extra resolution over the 2004 visible observations with WFC2."

toruonu writes "Yesterday evening the Large Hadron Collider at CERN for the first time accelerated protons in both directions of the ring to 1.18 TeV. Even though the 1 TeV barrier per beam was first broken a week ago, this marks the first time that the beam was in the machine in both directions at the same time, allowing possibly for collisions at a center of mass energy of 2.36 TeV. Although the test lasted mere minutes, it was enough to have detectors record the very first events at 2.36 TeV. LHC passes Tevatron (the particle collider at Fermilab that operates at 1.96 TeV) and becomes the highest energy particle collider in the world (so far it was effectively just the highest energy storage ring...)"

Conchobair was one of several users letting us know that Myspace has snapped up free music streaming site imeem. Visitors to the imeem site are being sent to a MySpace redirect page, which states that they are "working to migrate your imeem playlist to MySpace Music." Currently there is no way to access imeem music or playlists or to make use of imeem apps on Android or iPhone. The AP reports that the deal was done for less than $1M — not bad for 16M subscribers — noting that the music startup was running out of cash. PC Mag notes: "Last week it was announced that Apple had purchased Lala, and now MySpace snaps up imeem. Are Pandora and Rhapsody next?"

An Israeli city is using DNA analysis of dog droppings to reward pet owners who clean up after their pets and punish those who don't. A six-month trial program launched this week, in the city of Petah Tikva, to tackle the dog mess problem in a high tech way. The program asks dog owners to take their pets to a veterinarian, who then swabs its mouth and collects DNA. The city will use the DNA database it is building to match droppings to a dog and identify its owner. Owners who scoop up their dogs' droppings and place them in specially marked bins will be eligible for rewards of pet food coupons and dog toys. Those who leave the poo on the street face fines. I wonder what sin you had to commit in a previous life to find yourself the official dog poop examiner of Petah Tikva, Israel.

getupstandup1 writes "Ulteo today unveiled their Virtual Desktop (screenshots, download) which is a free, full Linux desktop that runs seamlessly on Windows. It's interesting because it's not running under Xen or VMWare, but instead uses the coLinux patch, which they claim allows the system to achieve 'great performance, close to a native installation on the PC.' No need to reboot the system anymore to switch from Windows to Linux." We discussed Ulteo when the Ubuntu-derived distro was announced a year back.
