Making something then being able to sit on it for 40 years and prevent creative people from making a derivative work does NOT encourage creativity.
So we should not give copyright to not enable that.

Copyright longer than five years does not encourage overall creativity so, to encourage creation - the whole purpose of copyright - copyright after five years must be removed.
