I don't know about your laws, and IANAL either. But here in Germany you do not necessarily need to do something illegal to be fined. There is something which would translate to "failure to render assistance". Well, if Valve would bring out Half Life 3 alongside a new Source Engine completely based upon OpenGL, OpenAL and OpenCL for Windows, MacOS X and Linux, that would boost OpenAL and imho pretty much make it the de-facto standard across distros pretty fast. They got the tools, they got the franchise and perhaps the expertise. Everything that is lacking maybe is management ready to take a risk or two.
