RIAA Has to Disclose Attorneys Fees In Foster Case 193

NewYorkCountryLawyer writes "The RIAA has been ordered to turn over its attorneys' billing records by March 26, 2007, in Capitol v. Foster in Oklahoma. The 4- page decision and order, issued in connection with the determination of the reasonableness of Ms. Foster's attorneys fees, requires the RIAA to produce the attorneys' time sheets, billing statements, billing records, and costs and expense records. The Court reviewed authorities holding that an opponent's attorneys fees are a relevant factor in determining the reasonableness of attorneys fees, quoting a United States Supreme Court case which held that 'a party cannot litigate tenaciously and then be heard to complain about the time necessarily spent by his opponent in response' (footnote 11 to City of Riverside v. Rivera)."

Snowgen writes "Viacom has filed a $1,000,000,000.00 lawsuit for 'massive intentional copyright infringement' against Google over YouTube video clips. '"YouTube's strategy has been to avoid taking proactive steps to curtail the infringement on its site," Viacom said in a statement. "Their business model, which is based on building traffic and selling advertising off of unlicensed content, is clearly illegal and is in obvious conflict with copyright laws.'"

The Xoxo Reader writes "Today's Washington Post carries a front-page article on the internet message board AutoAdmit (a.k.a. Xoxohth), which proclaims itself the "most prestigious law school discussion board in the world." The message board has recently come under fire for emphasizing a free speech policy that allows its users to discuss, criticize, and attack other law students and lawyers by name. Is this an example of free speech and anonymity gone too far, or is internet trolling just a necessary side effect of a policy that otherwise promotes insightful discussion of the legal community?"

Carl Bialik from WSJ writes: "More companies are forgoing desktop and laptop computers for dumb terminals — reversing a trend toward powerful individual machines that has been in motion for two decades, the Wall Street Journal reports. 'Because the terminals have no moving parts such as fans or hard drives that can break, the machines typically require less maintenance and last longer than PCs. Mark Margevicius, an analyst at research firm Gartner Inc., estimates companies can save 10% to 40% in computer-management costs when switching to terminals from desktops. In addition, the basic terminals appear to offer improved security. Because the systems are designed to keep data on a server, sensitive information isn't lost if a terminal gets lost, stolen or damaged. And if security programs or other applications need to be updated, the new software is installed on only the central servers, rather than on all the individual PCs scattered throughout a network.'"
