Twitch Warns Streamers Another Wave of Copyright Strikes is Coming (theverge.com) 63

Twitch has received a "batch" of new takedown notices from music publishers over copyrighted songs in recorded streams (known as VODs), the company said in an email to streamers today. From a report: The notice may be worrying for some streamers who were affected by the waves of takedowns that hit last year, because if a user gets three copyright strikes on their channel, they will be permanently banned from the platform, according to Twitch's policies. With this advance warning, it seems Twitch is trying to get ahead of a sudden flurry of takedowns and give streamers some time to remove potentially offending VODs.

"We recently received a batch of DMCA takedown notifications with about 1,000 individual claims from music publishers," Twitch said in an email Friday, which was sent to a Verge staffer. "All of the claims are for VODs, and the vast majority target streamers listening to background music while playing video games or IRL streaming." [...] In Friday's email, Twitch noted that the only way to avoid DMCA (or Digital Millennium Copyright Act) strikes is to not stream copyrighted material in the first place, and said that if a streamer does have unauthorized content in their VODs or clips, "we strongly recommend that you permanently delete anything that contains that material."

Amazon's Ad Revenue Is Now Twice As Big As Snap, Twitter, Roku and Pinterest Combined (cnbc.com) 11

The major growth in Amazon's advertising unit means its revenue contribution is now 2.4 times larger than Snap, Twitter, Roku and Pinterest combined, and it's growing 1.7 times as quickly, according to Loop Capital. CNBC reports: Amazon's "Other" unit, which is primarily made up of advertising but also includes sales related to other service offerings, grew revenue a whopping 77% year-over-year to more than $6.9 billion in the first quarter, the company reported last month. "Performance ads on the ecommerce sites fueled by Amazon's high-intent traffic and unparalleled user insights are providing significant value for sellers and brands," Loop Capital analysts wrote in the Monday note.

They also cited the company's presentation at the recent IAB NewFronts that discussed the company's efforts in the streaming space. Amazon said early this month its ad-supported streaming video content now reaches more than 120 monthly users every month, driven by platforms like Twitch. Amazon generated $22.4 billion in ad revenue in the past 12 months, up 65% year-over-year, according to Loop. That was 2.4 times the $9.3 combined revenue total of middle-cap ad platforms Snap, Twitter, Roku and Pinterest, which grew by 38% over that same timeframe.

"The official Python software package repository, PyPI, is getting flooded with spam packages..." Bleeping Computer reported Thursday.

"Each of these packages is posted by a unique pseudonymous maintainer account, making it challenging for PyPI to remove the packages and spam accounts all at once..." PyPI is being flooded with spam packages named after popular movies in a style commonly associated with torrent or "warez" sites that provide pirated downloads: watch-(movie-name)-2021-full-online-movie-free-hd-... Although some of these packages are a few weeks old, BleepingComputer observed that spammers are continuing to add newer packages to PyPI... The web page for these bogus packages contain spam keywords and links to movie streaming sites, albeit of questionable legitimacy and legality...

February of this year, PyPI had been flooded with bogus "Discord", "Google", and "Roblox" keygens in a massive spam attack, as reported by ZDNet. At the time, Ewa Jodlowska, Executive Director of the Python Software Foundation had told ZDNet that the PyPI admins were working on addressing the spam attack, however, by the nature of pypi.org, anyone could publish to the repository, and such occurrences were common.

Other than containing spam keywords and links to quasi-video streaming sites, these packages contain files with functional code and author information lifted from legitimate PyPI packages... As previously reported by BleepingComputer, malicious actors have combined code from legitimate packages with otherwise bogus or malicious packages to mask their footsteps, and make the detection of these packages a tad more challenging...

In recent months, the attacks on open-source ecosystems like npm, RubyGems, and PyPI have escalated. Threat actors have been caught flooding software repositories with malware, malicious dependency confusion copycats, or simply vigilante packages to spread their message. As such, securing these repositories has turned into a whack-a-mole race between threat actors and repository maintainers.

China Calls out ByteDance, Kuaishou, and LinkedIn For Illegal Data Collection (scmp.com) 23

China's internet watchdog has named and shamed some of the country's most popular mobile applications, including the Chinese version of TikTok, Kuaishou, LinkedIn and 102 other apps, for the illegal collection and use of personal data. From a report: The Cyberspace Administration of China (CAC) said that after receiving complaints from users, it had found that 105 apps had violated several laws and had infringed personal information through illegal access, over-collection and excessive authorisation, according to a notice on its WeChat official account. Short video apps including Kuaishou and ByteDance-owned TikTok were included in the list as well as Microsoft-owned LinkedIn and Bing, Tencent-owned music streaming service Kugou, and search giant Baidu's mobile browser.

Epic Tries To Show Apple Is Antitrust Violator Beyond App Store (bloomberg.com) 104

A top Apple executive tasked with defending the App Store in a monopoly lawsuit by Epic Games found himself having to answer Tuesday for a spate of other alleged antitrust fouls by the world's most valuable company. From a report: During Phil Schiller's cross-examination in a trial in Oakland, California, Apple's former global marketing chief was confronted about several instances in which the company has locked in users and made it difficult for them to switch away from its devices. Katherine Forrest, a lawyer for Epic, pointed out that Schiller emailed his colleagues a 2016 news article titled "iMessage is the glue that keeps me stuck to the iPhone," which explained that Apple's messaging platform is a reason people don't switch to Android devices.

She also quizzed Schiller on the idea that users can't easily move music and video purchased on Apple services to Google's Android. She went further, indicating that Apple's iCloud Keychain service for storing passwords on Apple devices can't synchronize with Android devices. Her point: Apple doesn't just lock in developers with its App Store rules, it also locks in consumers, limiting their ability to switch to competitors. In response, Schiller said many users subscribe to video and music streaming services and can input their passwords into a new device manually. He also suggested that users could use third-party password managers.

Rotten Tomatoes Is Launching a Linear Streaming Channel (variety.com) 24

Rotten Tomatoes is continuing on its quest to grow into something substantially bigger than its Tomatometer movie and TV rating scores. From a report: The website -- owned by NBCUniversal's Fandango -- expands its entertainment footprint with the launch of The Rotten Tomatoes Channel, a new over-the-top streaming service that will initially debut on on The Roku Channel. The OTT service will then come to NBCU's Peacock platform and Comcast-owned Xumo, with other distribution deals in the works including with internet pay-TV providers, according to Fandango. The first 24-hour linear video channel from Rotten Tomatoes will loop about 100 hours of premium programming around the clock on the channel, culled from RT's stable or original shows.

With the launch of The Rotten Tomatoes Channel, Fandango wants to expand its audience reach and provide new entry-points into the entire Fandango ecosystem (i.e., to push movie tickets and digital sales or rentals). Some of the shows on The Rotten Tomatoes Channel will include "Countdown," a show discussing the best upcoming movies and shows according to the Tomatometer and panelists; "The Vault," a nostalgic look back at star interviews, red carpet chats, games and more from the Rotten Tomatoes archives; "Trailers Reloaded," recapping the biggest movies and shows with an extensive collection of trailers; and "Rotten Tomatoes Essentials," a look back at movies, shows, stars and directors that defined genres and eras.

After collaborating on various projects for several years, the relationship between Microsoft and Apple is getting testier again. From a report: [...] Around the time the PC character reappeared, Microsoft began bad-mouthing Apple to regulators, saying the company's App Store was anti-competitive. The Redmond, Washington, software giant had thrown in its lot with Epic Games, which was suing Apple for booting its Fortnite title from the App Store and accusing the iPhone maker of monopolistic behavior. A Microsoft executive has since testified against Apple at the trial, now in its second week, telling the court that Apple's tight control of its App Store had hurt Microsoft's own gaming efforts. The tensions are unlikely to ease once a verdict comes down because Apple and Microsoft are both looking to dominate the next big things in tech -- from artificial intelligence and cloud computing to gaming, tablets, custom processors and mixed-reality headsets.

The renewed antipathy between Apple and Microsoft started about a year ago. Microsoft had developed a cloud gaming service for iPhones and iPads called xCloud. One app would let users pay a monthly fee to Microsoft and stream dozens of different gaming titles from the cloud. The service was supposed to do for gaming what Netflix did for video, appease gamers and turn Apple devices into a more powerful gaming platform backed by Xbox, one of the hottest names in the industry. But Microsoft never launched the service in its intended form, having failed to persuade Apple to loosen App Store rules forbidding all-in-one gaming services. Originally, Microsoft was barred from launching any cloud-based games at all. But a few months after concerns over the ban on streaming apps went public, Apple tweaked the rules.

Microsoft can now launch a cloud gaming service, but each game must be downloaded separately, defeating the purpose of an all-in-one solution. Now Microsoft is rolling out the service on Apple devices via the web, a much less optimal experience than a real app. Around the same time, Microsoft President Brad Smith began urging U.S. and European antitrust regulators to examine Apple's practices.

Netflix's Dominance Starts to Slow as Streaming Rivals Gain (nytimes.com) 78

The New York Times reports: Netflix still rules the streaming universe. As of the end of March, it had 207.6 million total paying subscribers, with about 67 million in the United States, the company noted in an earnings report on Tuesday. But its main competitors — Disney+, HBO Max, Paramount+ and AppleTV+, as well as the old-guard streamers Amazon Prime Video and Hulu — have cut into Netflix's share of viewers' attention... according to the data firm Parrot Analytics, which has developed a metric to rate not only the number of viewers for given shows, but their likelihood of attracting subscribers to a streaming service.

In its latest rankings, Parrot reported that Netflix's share of total demand — a measure of the popularity of its shows — was slightly above 50 percent for the first three months of the year, compared with 54 percent a year ago and 65 percent in the first quarter of 2019. In other words, competitors have started eating into Netflix's dominance.

That showed up in the numbers. For the first quarter of 2021, Netflix reported the addition of four million new customers, below the six million it had forecast. The company expects to add only one million new customers for this current quarter ending in June. Netflix shares plummeted about 10 percent in after-hours trading on Tuesday, after the earnings announcement...

Although competitors are gaining ground, Netflix is in its best financial shape of its history. It hit a milestone at the end of last year, when it said it would no longer look to borrow money to fund its content slate. Another way to look at it: Netflix finally became a truly profitable business after topping 200 million subscribers, each paying an average of $11 a month. In other words: Its competitors are still losing lots of money on streaming.

Though Netflix didn't pick them up for another season after 2019, "We still want to keep making new episodes," series creator Joel Hodgson explains in an online video on Kickstarter. And with 12 days left to go, 18,969 online fans have already pledged $3,348,705, funding six new episodes...

But in addition the first $2 million funded the creation of the Gizmoplex, "our very own virtual online theatre," while the first stretch goal was also funded — the creation of MST3K apps for Android, iOS, and streaming services like AppleTV and Roku. "I'm tired of other people deciding if our show lives or dies," explains Crow T. Robot in the Kickstarter video. "I wanna do that." New host Jonah Heston adds, "If we want MST3K to keep going long-term, maybe networks aren't the most reliable option. Maybe it should be up to the fans to decide how long we keep going..."

Their next stretch goal of $4.4 million would fund three more episodes, but will also allow them to invite backers to the Gizmoplex for live monthly events, "for at least a year." And if they reach their goal of $5.5 million, they'll fund three more episodes — so an entire 12-episode season — as well as 12 short-subject films.

The ultimate hope is to host frequent live screenings, premieres, and community events in the Gizmoplex — while fans can even host their own MST3K watch parties whenever they want. And their Kickstarter page even suggests they might someday extend the Gizmoplex into virtual reality (accessible on computer and headsets).

39% of Americans Say Netflix Has Best Original Content of All Streaming Services, Survey Finds (variety.com) 79

The lion's share of U.S. consumers say the streamer has the best original programming, according to a new Morgan Stanley survey. Variety reports: Netflix remains the most frequently cited as offering the best original programming -- with 38% of survey respondents picking it as No. 1, per the Wall Street analyst firm's 2021 streaming survey. That's roughly in line with Morgan Stanley's previous surveys. On the 2021 survey, 12% of respondents said Amazon Prime Video offers the best original programming, followed by Disney Plus, Hulu and HBO Max which each scored 6%-7% of total responses.

Among Netflix customers, the top reasons cited for subscribing to Netflix were "broad selection of content" (55%), "good original programming" (51%), "adds content I like" (49%) and "no commercials" (46%). In 2021, Netflix is projected to spend about $19 billion on content according to a forecast by financial research firm Bankr, up about 10% from last year. Netflix retains the No. 1 spot as the most widely used streaming service with 58% of respondents saying they use the service. Amazon Prime Video came in at 45% (up 400 basis points year over year), Disney Plus was at 31% (up 650 basis points), and HBO/HBO Max was 20% (up 500 basis points).

Twitch Will Ban Users For 'Severe Misconduct' That Occurs Away From Its Site (reuters.com) 320

An anonymous reader quotes a report from Reuters: Live-streaming service Twitch will ban users for offenses such as hate-group membership or credible threats of mass violence that occur entirely away from the site, in a new approach to moderating the platform, the company said on Wednesday. The Amazon-owned platform, which is popular among video gamers, said under its new rules it would take enforcement actions against offline offenses that posed a "substantial safety risk" to its community.

It said examples of this "severe misconduct" include terrorist activities, child sexual exploitation, violent extremism, credible threats of mass violence, carrying out or deliberately acting as an accomplice to sexual assault and threatening Twitch or its staff. "Taking action against misconduct that occurs entirely off our service is a novel approach for both Twitch and the industry at large, but it's one we believe -- and hear from you -- is crucial to get right," the company said in a blog post. The company said users will be able to report such behaviors but it may also investigate cases proactively, for instance if there is a verified news report that a user has been arrested. Twitch said it would rely more heavily on law enforcement in "off-service" cases and is partnering with an investigative law firm to support its internal team. It declined to name the firm. The new standards will apply even if the target of the offline behaviors is not a Twitch user or if the perpetrator was not a user when they committed the acts. Perpetrators would also be banned from registering a Twitch account, it said.

Twitch said it would take action only when there was evidence, such as screen shots, videos of off-Twitch behavior or police filings, verified by its internal team or third-party investigators. Users who submit a large amount of frivolous reports will face suspension. The company said in cases where the behavior happened in the distant past, users had gone through rehabilitation such as time in a correctional facility, and they no longer presented a danger to the community, it might not take action or might reinstate users on appeal. It said it would share updates with the involved parties but would not share public updates about actions under this policy.

The Chicago Tribune argues all you needed to know about Joss Whedon's original 2017 version is encapsulated in the 68-second YouTube video "Sad Affleck." (An SFGate columnist calls the new version "vastly better.") But the Tribune calls Snyder's four-hour director's cut "a 14-year-old's idea of gravitas. Epic, violent, full of naughty words, told with the lyricism of a pharmaceutical ad about bloating. And more importantly, for now, it's complete."

Yahoo Entertainment's Insider has compiled "The 45 biggest differences between 'Zack Snyder's Justice League' and the 2017 theatrical version." But Variety just specifically asked Zack Snyder, "Why is Justice League so violent?" [T]he violence in "Justice League" is bloodier and more violent than audiences are typically accustomed to with superhero movies, which are almost always rated PG-13 — and therefore largely bloodless. Snyder wanted to push the envelope. "It's a pure exercise in creative freedom," the director told Variety this week... Snyder says knowing his film would be streaming on HBO Max freed him from having to make his "Justice League" work for a PG-13 rating.

"Let's just do it the exact way we would if there was no ratings board," he said of his team's thinking. "Let's not use any second guessing. Let's just do it the way we think is the coolest. That was the philosophical approach." Part of the reason that "Justice League" is so violent is to realistically demonstrate what it would be like to actually face off against god-like superheroes.

ComicBook.com reports that Snyder is now also planning "a multi-day SnyderVerse movie marathon later in 2021, where showings of Man of Steel and Batman v Superman: Dawn of Justice will culminate in a theatrical IMAX screening of Zack Snyder's Justice League. The filmmaker is a "huge admirer" of the Justice Is Gray Edition in IMAX, calling it the "ultimate version" of Justice League that is "sort of the penultimate ridiculous movie that shouldn't exist at its highest most fetishistic level."
Snyder tells Esquire his four-hour re-edit was "a labor of love and I would do it again in a second. I wouldn't hesitate. And look, we were doing it for free. I really didn't care. I just wanted to get it, fix it."

Esquire adds that "Even if you decide not to dive into a four hour super hero movie, at least take away a lesson from the making of the Snyder Cut: in a time when so much of us have experienced wrongs and tragedy, sometimes wrongs can be righted, and sometimes your biggest visions find a way to get out into the world."

AT&T Lies About California Net Neutrality Law, Claiming It Bans 'Free Data' (arstechnica.com) 91

An anonymous reader quotes a report from Ars Technica: AT&T lied about California's net neutrality law yesterday when it claimed the law requires AT&T to stop providing "free data" to mobile customers. In reality, the California law allows AT&T to continue zero-rating HBO Max, its own video service, as long as it exempts all competing video services from data caps without charging the other video providers. But instead of zero-rating all video without collecting payments from its competitors in the online-video business, AT&T decided it would rather not exempt anything at all.

"Unfortunately, under the California law we are now prohibited from providing certain data features to consumers free of charge," AT&T claimed in its announcement that it is ending the "zero-rating" program that exempts some content from data caps. "Given that the Internet does not recognize state borders, the new law not only ends our ability to offer California customers such free data services but also similarly impacts our customers in states beyond California," the AT&T announcement also said. Going forward, AT&T will no longer exempt the AT&T-owned HBO Max from its mobile data caps and will stop the "sponsored data" program in which it charges other companies for similar exemptions from AT&T's data caps. But this is a business decision, not purely a legal one: as we already stated, AT&T could exempt all video streaming services including HBO Max from its mobile data caps without violating the California law as long as AT&T stops charging rival video companies for the same data-cap exemptions.

Amazon Will Spend $1 Billion Per Year on NFL's Thursday Night Football (arstechnica.com) 38

The NFL wrapped up its broadcast contract negotiations for the next eleven years, and a big winner was Amazon, which scored exclusive national rights to Thursday Night Football (TNF). From a report: Going forward, the NFL's weekly Thursday games will be exclusive to Amazon Prime Video, a big change for a package that was previously on terrestrial television or cable. The deal runs from 2023 to 2033 and, according to a report from CNBC, will see Amazon pay $1 billion per year for the TNF package. Thursday Night Football is the NFL's newest and cheapest TV package, but the deal lets Amazon creep closer to parity with the NFL's other licensees, mainstream TV networks like Fox Sports, ABC/ESPN (Disney), CBS (Viacom), and NBC (Comcast). CNBC's report has the other four channels paying upward of $2 billion per year each, and unlike Amazon, the TV networks get to take turns airing the Super Bowl. The NFL's new deal contains streaming provisions for the other providers, too. Each network can now simulcast their games on their streaming service, and some deals scored one or two streaming-exclusive games.

From a report: By way of an Android 11 update, Edge Plus users on Verizon can now connect the handset to a bigger screen for a desktop-style experience in the vein of Samsung's Dex. In a nutshell, that means you'll be able to access all the productivity, gaming and streaming apps on your phone on a monitor or TV. Motorola hopes that you'll use it for everything from editing work documents and making video calls (which should look great thanks to the solid collection of cameras on the Edge Plus) to playing Fortnite -- or a cloud gaming service like Xbox Game Pass or Google Stadia (via a Bluetooth controller) -- to watching Netflix. The new "Ready For" platform uses a multi-window interface that launches when you connect to a screen through the USB-C or HDMI port. You can also add accessories like a keyboard or mouse to further match the feel of a desktop. There's no dedicated app and you can use your phone as a second screen while working on a bigger display. To help with that, Motorola is releasing a "Ready For" dock on April 19th on Amazon, with pricing to be announced closer to launch.

Google Antitrust Suit Takes Aim At Chrome's Privacy Sandbox (theverge.com) 16

AmiMoJo shares a report from The Verge: State antitrust watchdogs are targeting Google's plans to phase out third-party tracking cookies, building on a major lawsuit filed last year. The group of 15 attorneys general, led by Texas, updated its complaint about Google yesterday to include a more detailed case against the search giant, including new claims about Google's strategic use of the Chrome browser. In particular, the new complaint takes aim at recent privacy updates to Chrome, which could better protect users' personal data while also entrenching Google's market position.

Like the original Texas complaint, Tuesday's updated filing primarily focuses on Google's technology for targeting ads across the web. The attorneys general argue that Google used its power in search, streaming video, and other markets to stamp out independent advertising platforms, forcing small businesses and media outlets to use its system. But in the updated complaint, the states apply this argument to Google's 'Privacy Sandbox' -- a tool that's supposed to replace invasive third-party tracking cookies with a more limited system devised by Google.
"Google's new scheme is, in essence, to wall off the entire portion of the internet that consumers access through Google's Chrome browser," the complaint reads. "Google is trying to hide its true intentions behind a pretext of privacy," the suit continues. With Privacy Sandbox, "Google does not actually put a stop to user profiling or targeted advertising -- it puts Google's Chrome browser at the center of tracking and targeting."

In response, Google said the new allegations rested on a misunderstanding of Chrome's privacy features. "Attorney General Paxton's latest claims mischaracterize many aspects of our business, including the steps we are taking with the Privacy Sandbox initiative to protect people's privacy as they browse the web. These efforts have been welcomed by privacy advocates, advertisers and our own rivals as a step forward in preserving user privacy and protecting free content. We will strongly defend ourselves from AG Paxton's baseless claims in court."
