I love conflict. Conflict moves us forward. And if Massachusetts loses the "sex change" case in federal court, even if he loses in the Supreme Court, Governor Mitt Romney should just say No. No, we will not give this man a sex change operation, and if you want to try to force us, go ahead. Of course, I cannot see this, or any, Supreme Court upholding such a ruling.

A guy taking the hormones and stuff, already looked completely female, including breasts, but still had the 'equipment'. Put'm in a male lockdown, and the court upheld the ruling that since 'she' was a male biologically, 'he' had to stay in a male prison.
The show ended with 'him' in the hospital because of a massive beating and gang rape.
I dunno if there is a good solution to this problem...

I saw the Law and Order in question, and though they invoked a lot of sympathy for the perp because he/she had killed out of love and perceived self defense, and I think hadn't even had trial yet, I agree with you on this point. There's only so far the law is required to go.

No, they won't. The only grounds they COULD uphold it under would be "cruel and unusual punishment," but how could it be cruel and unusual to *not* change someone's sex just because they will kill themselves if you don't? That makes no sense. The Supreme Court only has the final say on something that is within their jurisdiction. This, clearly, is not a federal matter.

Would you advocate states doing the same thing on other Supreme Court decisions that are by definition out of their jurisdiction, such as rulings that assume the federal government has jurisdiction over religion?

But this case is different because it is forcing the state to pay a lot of money. It's one thing to say you can't do something, another to say you have to do something.
