I've found it ridiculous that what I do in my own bedroom, behind locked doors, with a consenting adult whom i'm married to, is any business of the state of South Carolina. Encouraging a certain behaviour that adheres to the standards of society is a good thing, legislating morality is not. Forcing values down peoples throats rarely leads to them accepting it.
Went Rick Berman first weighed in with his comments about this meaning that polygomy and other things would become legal I was at first outraged but reading some more gave me pause for thought.
The thing is that a lot of these laws (both the good and the bad) were based on public morals/decency clauses. So, now incest laws should be rewritten on public health and science standards. The question though is do you/how do you outlaw polygamy then? Consenting adults doing private acts would seem to be allowed
I'm not a lawyer but, I think it's pretty much gauranteed that incest between adults will become legal. From my reading of the decision: in order to justify a prohibition there must be a compelling state interest. Given the ease of access to birth control there is not a compelling state interest. Polygamy is different. The decision said there is no requirement to give formal recognition to homosexuals (gay marriage), so polygamy laws won't be changed.
The question though is do you/how do you outlaw polygamy then? Consenting adults doing private acts would seem to be allowed. (Personally I really don't know whether I approve or disapprove of polygamy.)

I think you need some kind of legal construct to build families around. Now does that mean the ol' one man one woman type? Nah. The real benefits of marriage right now have to do with inheritance, separation, and most importantly insurance and other benefits. If you abolish that then you've placed a horrendous burden on families by not covering the stay at home Mom with health insurance and the like.
Personally I think if the people are happy (and have enough stamina:-D)
I am not going to comment on the courts rulling, but another problem with these two people was that when the police came in with an arrest warrent, they continued with their intercource. That should be punishable. If they had stoped I don't think there should be any penatly, but they continued, so there should be one. I would also support a penatly for a strait couple that would not stop haveing intercource if police showed up with an arrest warrent.
They didn't have an arrest warrant. They were investigating a possible burglary or something like that. Anyway, it's my domicile, I'll fuck if I want to.
