So wrong, taking a person's picture is an original work. Using your analogy it would be more like "claiming your not adding anything when photographing a photograph of a person". Basically if your work is not changing the original it is not derivative and thus not new(or newish), amount of time and effort spent do not factor in originality.

No, that isn't the argument at all. The point of traffic shaping (a.k.a. Quality of Service) is that some kinds of traffic need to arrive in a timely manner, while for other kinds of traffic there won't be any noticeable effect if the packets arrive a second or two later. Voice and video streams become practically useless if there's significant delays or packet loss, while your Linux disc image will work just fine even if the download finishes 15 seconds later than it otherwise would.

traffic shaping is not also known as Quality of Service, quick googles can find definitions and loads of information. Yes it can be used to achieve QoS but it is not the same thing.

As for your arguments about ISP's overselling their bandwidth, well yeah, we all know that, and we all know about the near-universal lack of competition, but those issues are generally separate from Quality of Service and Network Neutrality.

So you cannot see how almost no competition and overselling affect QoS and Network Neutrality? That boggles my mind. I won't even waste my time on an analogy... you're out to lunch on that fella

I disagree she is guilty based on said evidence. An ip address is far less reliable then a phone number or house address and neither of those are enough to prove guilt. If somebody dies in my house it doesn't prove that I did anything it just makes me a suspect. They should also have to prove the address was assigned to her account within the time frame the downloading occurred. I also believe you should have to place her on the premises when the downloading started. I know people use my pc without my supervision. As far as a username goes that is complete joke, at the very least you should have to connect the registration of the username to her email otherwise stop wasting my time.

I strongly suggest you perform a simply google search before simply assuming the grass is greener. Without even taking into context how long the wait is for cancer treatment, cost alone (in the US) would assure most people cannot afford treatment Link, so I guess you are correct wait time does go down. Lucky for you, you can simply cross the border dip into your pocket and see how that treats you.
