Do you think it's easy to get "paid" as an individual inventor or even a startup company of average financial means and sophistication?

Suffice to say, it is very, very difficult, and having the option of just selling their patent to anyone, without limits, offers some protection those inventors and startups from being preyed upon by large corporations.

If you can't appreciate this, then clearly the propaganda campaign from the big corporations is working.

And I'm speaking from the perspective of one of those average inventors.

Yes there are ALWAYS specialized courts and judges who know certain areas of law better than others. That is very common and normal.

The problem here is that it is well known in the legal industry that certain courts favour a specific side to a case before it is even presented or heard. And patent enforcement is one of them, and this has been known for 15-20 years. Nothing new here.

There's so much hate against these "NPE"s...but seems to me that that's just propaganda from the large corporations that are getting sued by them.

Why does it matter whether a patent owner is making products with their patents or not? Do you think large corporations that own thousands of patents always use all of them, and don't sue any alleged infringer if they aren't using them for a product?

If an average person puts in a substantial investment to invent something and have it patented first, but is not able, for whatever reason, to market the invention, should they not have the ability to either enforce on their patent, or sell it to anyone else?

The whole idea of patents is a social exchange - the inventor gets what is basically a time-limited "asset" (the patent) for publicly and permanently disclosing the details of their invention. Restricting and/or attacking the enforcement or selling / transfer of patents simply because the patent owner or buyer doesn't market any products only harms smaller entities and individuals, while benefiting larger entities or the rich. It is extremely expensive to market a product, and also for an average person or even a startup to sue another party, especially a larger company, for patent infringement.

Therefore, individuals and startups need as much freedom to deal with their patents as they can get - including the ability to sell it to anyone else, including NPEs, which is no different than "selling" (or assigning) any other legal claim.

Comment Netflix is lost... (Score 1) 181

Their original promise was to be an all-in-one place to find streaming content. They have failed in that.

They started making their own shows and movies, BUT they seem to make cancellation decisions based on short term results, which is bizarre considering many media properties have a track record of taking time to gain momentum and popularity. And in any case, as long as a media property is well developed and has a loyal following, it can be profitable in many ways over the long term. Instead, Netflix has ignore all of this and dangerously upsetting subscribers by cancelling such shows on a dime. I think what they also don't realize is that many people likely only watch one or two genres on Netflix... and if they keep getting disappointed by cancellations, they will just unsubscribe.

So this is a other fail by Netflix

Pretty much no innovation from Netflix for years as far as I can see, and a constant threat of reducing features/content or increased fees. For example, their app had annoying autoplay for so long and they knew it was not enjoyed but they dragged their feet on removing it. And other than a few minor changes, nothing new on the app - same old boring difficult to navigate interface that adds nothing to the viewing experience. There are many things that can be done without even touching the content library, but it seems like they no longer have the personnel or interest to improve.

Finally, subscribers are constantly bombarded with bad news from them, and not just more fees: ads, loss of content for various reasons, preventing sharing, cracking down on vpns, cancellations etc.

So this is yet another fail.
