While this comment is likely to get buried in the avalanche that preceeded it, I feel that it's necesary to point a few things out.

Most glaringly, the press release doesn't have any mention of Warner Bros. MGM doesn't hold the film rights to The Hobbit; Warner Bros. does, after purchasing them from the Saul Zaentz Corporation. The only thing that the press release mentions is that legal difficulties over The Lord of the Rings have been resolved, none of which involved the labyrinth of licensing issues around Tolkien's other works. Warner Bros. has been blocking the idea of letting the rights go ever since The Fellowship of the Ring turned out to be a hit. I see no indication that this has changed.

Second, although TheOneRing.net has a pretty good track record, they've been wrong before. Several years ago, they trumpeted the release of a "trailer" for The Hobbit, and later had to correct themselves when it turned out to be a fan-created work. Yes, TORn links to MGM's official media release page, but the only other link is to The Hobbit Blog. The blog seems to be officially sponsored by New Line, but the only link to it is in the sign-up page (for New Line's privacy policy), and the only link from New Line to the blog is in the press release, which is also posted on New Line's site. There aren't a lot of branches on this particular "family tree".

Next, there's Christoper Tolkien's long-standing disdain for any and all film adaptations of J.R.R.'s work. There wasn't much that he could do about The Hobbit and LotR, because his father sold the film rights to Zaentz himself. However, Christopher takes his position as his father's literary executor very seriously, and the chances that he will give the nod to use of any of his father's notes for a film that fills in the gap between The Hobbit and LotR are minute to the point of nonexistance.

I doubt that this is an elaborate hoax. I could see hacking one film studio site, but not two. However, I would be much more sanguine about the project if there were a linked article from an industry publication such as Variety, and preferably one that went into detail about how the legal wrangles with Warner Bros. and Zaentz were resolved.

University of Wisconsin-Madison researchers investigating the ingredients that go into a hurricane think they have found a reliable basis for predicting the overall strength of a hurricane season. Jim Kossin and Dan Vimont have found a basin-wide circulation pattern that offer one possible explanation in the previously unexplained differences in long-term hurricane trends. "Kossin and Vimont, a professor in the Department of Atmospheric and Oceanic Sciences, noticed that warmer water is just one part of a larger pattern indicating that the conditions are right for more frequent, stronger hurricanes in the Atlantic. The atmosphere reacts to ocean conditions and the ocean reacts to the atmospheric situation, creating a distinct circulation pattern known as the Atlantic Meridional Mode (AMM). The AMM unifies the connections among the factors that influence hurricanes such as ocean temperature, characteristics of the wind, and moisture in the atmosphere."

Seattle-based Spam Arrest has gone up against the creator of the food substance in court, fighting for the right to use the word spam in its company name. The US Trademark Trial and Appeal board has sided with the spam fighters, agreeing that consumers of the Spam product would never confuse the food with junk email. 'Derek Newman, Spam Arrest's attorney, said the decision opens the door for many other anti-spam software companies ... Canada's New DMCA Considered Worst Copyright Law 234

loconet writes "The government of Canada is preparing to attempt to bring a new DMCA-modeled copyright law in Canada in order to comply with the WIPO treaties the country signed in 1997. (These treaties were also the base of the American DMCA.) The new Canadian law will be even more restrictive in nature than the American version and worse than the last Canadian copyright proposal, the defeated Bill C-60. Among the many restrictive clauses in this new law, as Michael Geist explains, is the total abolishment of the concept of fair use: 'No parody exception. No time shifting exception. No device shifting exception. No expanded backup provision. Nothing.' Geist provides a list of 30 things that can be done to address the issues."

EMI May Cut Funding To RIAA, IFPI 158

Teen Bainwolf notes a report that Big Four record label EMI, which is under new ownership, is considering a big cut in its funding for the IFPI and RIAA. Each of the labels reportedly contributed over $132 million per year to fund industry trade groups, and EMI apparently believes that money could be better spent elsewhere. "One of the chief activities of the RIAA is coordinating the Big Four labels' legal campaign, and those thousands of lawsuits have done nothing but generate ill will from record fans, while costing the labels millions of dollars and doing little (if anything) to actually reduce the amount of file-sharing going on."

Feed Techdirt: Why Did NBC Make Life Harder For People Who Want To Buy Its Content? (techdirt.com)

It really is amusing to watch how the companies who are most worried about "piracy" (which is a misnomer) always seem to treat their legitimate customers the worst. We've all wondered why the movie companies put up those annoying anti-piracy ads that waste the time of the folks who actually paid. But, what's most amazing is how many of these content companies are so focused on "piracy" that they miss the fact that they need to provide a reasonable experience for people who actually want to purchase their content. Making life difficult is only going to drive those legitimate customer prospects towards the very activity they were most afraid of. Take NBC Universal, for example. The company is so worried about the threat of "piracy" that it's making up ridiculous stories about the harm caused to corn growers due to piracy. However, at the same time, it gets into a petty argument with Apple and pulls all of its content from iTunes -- which is where the majority of folks who wanted to pay for NBC's TV shows would go. The end result? NBC Universal, for all their worries about "piracy," just made life much more difficult for legitimate purchasers, most likely driving some of them to experiment with unauthorized downloads, just to get the content they would have happily paid for. For some reason, you don't seem to see these types of actions from the companies who aren't freaked out about piracy -- but perhaps that's because they know the way to succeed is to offer a better customer experience and more value, rather than worrying so much.
