Looks to me like they should approach this by making an 'osi approved' sticker to stamp the software, rather than saying that 'open source' is the 'osi approved' sticker.
I can understand their concern - as people tend to label open source as 'good' where there may be a clause in something that is claiming to be open which charges you loads of money..
