The EFF is wrong here, and Utah should be commended. The age of consent is eighteen. Period. Terms of Service agreements are contracts, and a business may not enter into a contract with a minor without guardian consent. Need a reason? Simple. Copyright conveyance is a good place to start. These contracts need to be deemed legally unconscionable, thus opening the door for compensation for any minor harmed by them, which will be a large number. What these companies have knowingly done to our youth is reprehensible, destructive, and in some cases, fatal.
Blame the parents fine...whatever. Parents cannot compete with legions of corporate boards, legal teams, psychological weaponry, and unimaginable piles of cash. In fact, I'd say the Supreme Court and Congress can't either. If one were to somehow get a punitive win against one of these companies, expect to the age of consent to become a federal law, with certain retroactive caveats protecting social media interests.
