By observing bees, the researchers noticed that bees pass back information on route quality. 'On a basic level, the honeybee's dilemma is a tale of two flower patches. If one patch is yielding better nectar than the other, how can the hive use its workforce most efficiently to retrieve the best supply at the moment? The solution, which earned Austrian zoologist Karl von Frisch a Nobel Prize, is a communication system called the waggle dance.' Any practical applications of that? Well, apparently ad servers, serving banners across a variety of servers, can report back on the time it took to generate the page."

More Evidence That XP is Vista's Main Competitor 428

Ian Lamont writes "Computerworld is reporting that Windows XP Service Pack 3 runs MS Office 10% faster than XP SP2 — and is 'considerably faster' than Vista SP1. XP SP3 isn't scheduled to be released until next year, but testers at Devil Mountain Software — the same company which found Vista SP 1 to be hardly any faster than the debut version of Vista — were able to run some benchmarking tests on a release candidate of XP SP3, says the report. While this may be great news for XP owners, it is a problem for Microsoft, which is having trouble convincing business users to migrate to Vista."

MPAA Chases Uploads, Ignores Open Sales of DVD-Rs? 156

rbrander writes "Go to TVBoxSet.com and find a remarkable sales site for box sets of TV shows, including not only surprisingly cheap deals, but offerings not found elsewhere. For example, they have a set with all ten seasons of 'JAG'. The problem is that the production company is only up to season 4 so far. Google "tvboxset" and find every link below the first is to a complaint or news website complaining of the scam. Those who do shop at the site get a product that appears to be a DVD-R recorded off of cable. The really odd thing? They're still in business! A story at the Montreal Gazette about the scam is six weeks old. Now what's in it for the content industry to beat up private citizens with $220,000 judgements or scrambling to get DeCSS sites shut down within hours, while corporate scammers openly sell pirate DVDs for months on end, unopposed?"

Has RIAA Abandoned the 'Making Available' Defense? 125

NewYorkCountryLawyer writes "The RIAA's standard complaint (pdf) was thrown out last month by a federal judge in California as speculation in Interscope v. Rodriguez. Interestingly, the RIAA's amended complaint (pdf), filed six days later, abandoned altogether the RIAA's 'making available' argument. (Whereby making files available at all for download is infringement.) It first formulated that defense against a dismissal motion in Elektra v. Barker. This raises a number of questions: Is the RIAA is going to stick to this new form of complaint in future cases? Will they get into a different kind of trouble for some of its their new allegations, such as the contention that the investigator "detected an individual" (contradicting the testimony of the RIAA's own expert witness)? And finally, what tack will defendants' lawyers take (this was one lawyer's suggestion)?"
