Video game publisher Atari Europe recently became concerned that copies of its game Alone in the Dark were floating around one-click file-hosting service RapidShare, so it took the hosting company to court. While they won the initial case, the decision was overturned on appeal, finding that RapidShare is doing nothing wrong."

It seems the harsh words from District Court Judge Philip Gutierrez on Wednesday had their intended effect; prosecutors in Matthew Crippen's Xbox modding case have now dismissed the indictment. Quoting Wired: "Witness No. 1, Tony Rosario, was an undercover agent with the Entertainment Software Association. He told jurors Wednesday that he paid Crippen $60 in 2008 to modify an Xbox, and secretly videotaped the operation. Rosario had responded to Crippen’s advertisement on the internet and met Crippen at his Anaheim house. All of that had been laid out in pretrial motions. But during his testimony, Rosario also said Crippen inserted a pirated video game into the console to verify that the hack worked. That was a new detail that helped the government meet an obligation imposed by the judge that very morning, when Gutierrez ruled that the government had to prove Crippen knew he was breaking the law by modding Xboxes. But nowhere in Rosario’s reports or sworn declarations was it mentioned that Crippen put a pirated game into the console. ... [Prosecutor Allen Chiu] conceded he never forwarded that information to the defense."

Ponca City, We love you writes "The Guardian reports that paleontologists have uncovered the remains of an ancient beast called Kosmoceratops richardsoni that stood 16 feet tall with a 6-foot skull equipped with 15 horns and lived 76 million years ago in the warm, wet swamps of what is now southern Utah. 'These animals are basically over-sized rhinos with a whole lot more horns on their heads. They had huge heads relative to their body size,' says Scott Sampson, a researcher at the Utah Museum of Natural History."

The index is stored in Google's BigTable distributed database, and Caffeine allows for incremental changes to the database itself. The system also uses an update to the Google File System codenamed 'Colossus.'"

Published in the journal Nature Geoscience, the study takes into account a rebounding of the Earth's crust called glacial isostatic adjustment, a continuing rise of the crust after being smashed under the weight of the Ice Age. 'We have concluded that the Greenland and West Antarctica ice caps are melting at approximately half the speed originally predicted,' said researcher Bert Vermeeersen."

js_sebastian writes "According to an article on the New York Times, a historical cross-over has occurred because of the declining costs of solar vs. the increasing costs of nuclear energy: solar, hardly the cheapest of renewable technologies, is now cheaper than nuclear, at around 16 cents per kilowatt hour. Furthermore, the NY Times reports that financial markets will not finance the construction of nuclear power plants unless the risk of default (which is historically as high as 50 percent for the nuclear industry) is externalized to someone else through federal loan guarantees or ratepayer funding. The bottom line seems to be that nuclear is simply not competitive, and the push from the US government to subsidize it seems to be forcing the wrong choice on the market."

The problem is I can't find any good joysticks for that purpose. There's a new version of the legendary Competition Pro, but judging from the many one-star reviews on Amazon, it's terrible. In a decision that was reversed as soon as someone with half a brain in their PR department learned about it, Verizon charged a widow a $350 early termination fee. After the death of her marine husband, Michaela Brummund decided to move back to her home town to be with her family. Verizon doesn't offer any coverage in the small town so Michaela tried to cancel her contract, only to be hit with an early termination fee. From the article: "'I called them to cancel. I told them the situation with my husband. I even said I would provide a death certificate,' Michaela said."

The most dramatic change is the move to a single-chip CPU/GPU hybrid processor that is apparently being built on the 45nm process technology from GlobalFoundries, AMD's spun-off production facilities. With the inclusion of the new processor, the Xbox 360 S uses much less power (about 30-40%) compared to previous generation machines, and also turns out to be much quieter as a result of a single, larger fan. The new console also takes measures to protect itself from overheating, so RRoDs shouldn't be a problem with this revision.

This is a cheat code that appeared in many of Konami's video games, starting around 1986 — my favorite places to use it were Contra and Life Force, 30 lives FTW. The Easter egg was probably included by a developer unbeknownst to the Newsweek powers that be. It's reminiscent of an incident that happened at ESPN last year, involving unicorns."

A British website called crabrevenge.com will help you prove that there is literally nothing you can't find online by selling you pubic lice. A disclaimer on the site says the creators "do not endorse giving people lice," and the lice are for "novelty purposes only." Leighann Adair, 10, was eating lunch Monday when a teacher confiscated the candy. Her parents said she was in tears when she arrived home later that afternoon and handed them the detention notice. But school officials are defending the sentence, saying the school was abiding by a state guideline that banned 'minimal nutrition' foods. 'Whether or not I agree with the guidelines, we have to follow the rules,' said school superintendent Jack Ellis."
