A mere few days after the EFF called upon Apple to Indemnify developers against alleged infringement of Lodsys patents on in-app purchases, Apple has sent Lodsys a letter defending developers. Apple argues that it has a license to the Lodsys patents that extends to individual developers making the Lodsys claims invalid. Hopefully the baring of legal teeth will put this matter to rest.

A 12-year-old girl who was being assaulted by her mother's ex-boyfriend used some quick thinking by sending a message on her iPod to a friend's Facebook account for help. The friend was able to contact the girl's mother who then contacted the police. 42-year-old Raymond Ernest Cesmat was arrested and charged with two counts of criminal sexual conduct in the first degree. He is being held at the Dakota County Jail on $175,000 bail.

Luyseyal writes "I unwittingly bought one of these terrible flash cards at Fry's and have managed to nuke two of them, successively. I have a USB flash card reader that will read/write the current one at USB 1.0 speed, but it locks up every Ubuntu and XP machine I've come across in high-speed access mode. I have read that if I low-level format it that it could be fixed, though my current one doesn't support it. My Google-fu must be weak because I cannot seem to find a USB flash reader that specifies that it will do low-level formatting." Can anyone offer advice for resurrecting such drives?

You can buy and sell actor or movie "stock" for virtual cash on the website Hollywood Stock Exchange (HSX). Starting in April the company plans on letting you turn those movie performance predictions into real dollars. HSX filed with the US Commodity Futures Trading Commission for approval as an active trading site in November 2008 and has just entered the final phase of regulatory review. Richard Jaycobs, president of HSX's parent company, said, "The number of people who visit movie theaters each year and form opinions about a film's success is in the tens of millions. We believe that's the reason the public response to this product has been very positive."

CBRcrash writes "Apparently, if iPhone users decide that they want a refund for an app (users can get a refund within 90 days, according to Apple policy), Apple requires that developers give back the money they received from the sale. But, here's the kicker: Apple will refund the full amount to the user and says that it has the right to keep its commission. So, the developer not only has to return the money for the sale, but also has to reimburse Apple for its commission."

Creative Paper attracted worldwide interest for its paper made of kangaroo droppings in 2005. Well it's been four years and the best and brightest at Creative Paper haven't been sitting on their laurels. What's their great new idea? They have now launched a kind of paper made from wombat poo. Scat-obsessed Darren Simpson from Creative Paper says the paper is green or gold depending on the time of year the droppings are harvested. The wombat paper will be unveiled at an international paper conference in Burnie, Australia later this month.

It stars a 4-year-old cutie named Kylie (Silverlight required) showing how easy it is to use Windows Live Photo Gallery to edit and share photos. And while it's impressive that little Kylie is able to transfer a snapshot of her pet fish from her camera to a PC, color-correct it, and e-mail it to her family, what's truly amazing is that the toddler was also apparently able to read, understand, and accept Windows Live's Terms of Use and Privacy Policy. (But minors can't legally execute contracts, can they?)"

jehovajerieh writes to us in the time-honored tradition of rampant Apple speculation, pointing to an article over on IBTimes suggesting that while the iPhone Nano may be on the way, the US might not be the first to experience this gadget bliss. "Despite limited information in the supplier channels and typical secrecy with new Apple products, insiders have confirmed that the iPhone nano is not yet in the testing labs at AT&T, Marshal says, leading him to believe that the launch will most likely be with a non-US carrier. 'Obviously, the best-case scenario here would be a China launch (~600mil+ wireless subscribers total in the country), but we have no definitive knowledge of this and are working on identifying the [locale] of launch and other pertinent details,' he said."

Trask writes "LivingDice has documents indicating that Gen Con LLC is up for sale. Additionally, there is an offer pending which could close by the end of the year. This may finally put an end to the uncertainty caused by Gen Con's chapter 11 filing and the recently dismissed Lucasfilm lawsuit."

missb writes "US researchers have found that prenatal treatment for Down syndrome works in mice. This raises the possibility that a pregnant woman who knows her unborn child has Down syndrome might be able to forestall some of the symptoms before giving birth. When fetal mouse pups that had a syndrome similar to Down's were treated with nerve-protecting chemicals, some of the developmental delays that are part of the condition — such as motor and sensory abilities — were removed."
