If I were apple I would be more concerned about protecting brand name so I-pad doesn't become the new 'band-aid' or 'kleenex' you lose a lot when you lose your trademark to a brand when it becomes so common as to become public domain.
I think public domain is the word for things like this. Xerox had a problem with it when people would 'xerox' a document independent of what brand of copy machine but seems to not be the case now. When you search for anything you 'google' it. lots of examples and its a fine line between market. generic word for petroleum jelly is just 'vasoline' dominance and losing your brand name rights. The issue is when a generic can start using your trademark as its product description. I'm not sure how many products had gone this far.
