AT&T Buries ToS Changes In 2500-Page Guide 99

JagsLive points out a story from the business section of the L.A. Times which begins: "Judging from the phone company's voluminous new online customer manual, if you have a problem with your bill, too bad: AT&T has sent customers an 8,000-word service agreement that, among other things, says people will be given 30-day notice of price increases only when 'commercially reasonable' and that you can't sue the company. Oh, and if you don't like AT&T's terms — providing you can make your way through the company's 2,500-page 'guidebook' — your only recourse is to cancel service."

RemyBR writes "Controversial scientific research happens all the time, but a review conducted by scientists in Japan uncovered a list of 'bizarre' trials - including one program designed to crossbreed cows with whales.'Scientists have analyzed 43 research papers produced by Japan over 18 years, finding most were useless or esoteric. The scientific research included injecting minke whale sperm into cows eggs, and attempts to produce test-tube whale babies.'"

Legal Counsel Advises Against Accepting OOXML Pledge 139

ozmanjusri writes "A legal analysis of Microsoft's Open Specification Promise (OSP), which was purportedly written to give developers protection from patent risk, says the promise should not be trusted. According to the Software Freedom Law Center, 'While technically an irrevocable promise, in practice the OSP is good only for today.' This is on the back of a chaotic ISO meeting to resolve outstanding specification problems. The session was described by Tim Bray as 'Complete, utter, unadulterated bulls**t. This was horrible, egregious, process abuse and ISO should hang their heads in shame for allowing it to happen.' The advice would seem to throw more doubt on OOXML's suitability as an international document standard. Microsoft responded to these assertions stating that they've already taken steps to answer these concerns"

Apple Sued Over Fundamental iTunes Model 257

tuxgeek writes "A suit was filed Wednesday against Apple over the possibility that the iTunes music store and iPod are 'illegally using a patented method for distributing digital media over the Internet.' ZapMedia Services filed the suit, accusing the well-known OS and computer manufacturer of violating patents obtained just recently. 'The patents in question cover a way of sending music and other digital content from servers to multiple media players, a broad description that could also apply to a wide swath of other companies selling digital media and the devices to play it. ZapMedia said it met with Apple to discuss licensing, but Apple rebuffed the offer.'"

proudhawk writes "The LA Times is reporting that the MPAA's Dan Glickman has taken another swipe against net neutrality at his recent ShoWest appearance. 'Glickman argued in his speech that neutrality regulations would bar the use of emerging tools that ISPs can use to prevent piracy. That's what some studio lobbyists have been telling lawmakers, too, in their efforts to derail neutrality legislation. And depending on how the regulations are written, they could be right.'"

robipilot writes "Video game publisher Activision Inc. has asked a federal court to declare that its popular "Guitar Hero" game does not violate a patent held by real-guitar maker Gibson Guitar Corp. Gibson's 1999 patent covers a virtual-reality device that included a headset with speakers that simulated participating in a concert, according to a complaint filed on Tuesday by Santa Monica, Calif.-based Activision in U.S. District Court in Los Angeles."

DOE Shines $14M on Solar Energy Research 164

coondoggie writes "Eleven university solar research projects aimed at developing advanced solar photovoltaic (PV) technology manufacturing processes and products got a $14 million boost today from the Dept. of Energy. Photovoltaic-based solar cells convert sunlight directly into electricity, and are made of semiconductor materials similar to those used in computer chips. When sunlight is absorbed by these materials, the solar energy knocks electrons loose from their atoms, allowing the electrons to flow through the material to produce electricity."
