The way I see it is this: They want controls on the left and all notification things on the right. The could've done it the other way around but they didn't. Get over it.

No, Nintendo is not being too harsh to the guy who leaked Super Mario Bros. It's one thing to leak software/games that have been out, but to release it before it's out? He's stupid for thinking it was a good idea.

I think putting Copyrighted photos on there could be a bad idea. Imagine if the photo was used out of context.
