Atari Loses Copyright Suit Against RapidShare 198

Video game publisher Atari Europe recently became concerned that copies of its game Alone in the Dark were floating around one-click file-hosting service RapidShare, so it took the hosting company to court. While they won the initial case, the decision was overturned on appeal, finding that RapidShare is doing nothing wrong."

Super Mario Bros. 3 Level Design Lessons 95

An anonymous reader writes with this excerpt from Significant Bits about how the early level design in Super Mario Bros. 3 gradually introduced players to the game without needing something as blatant and obtrusive as a tutorial: "Super Mario Bros. 3 contains many obvious design lessons that are also present in other games, e.g., the gradual layering of complexity that allows players to master a specific mechanic. What surprised me during my playthrough, though, was how some of these lessons were completely optional. The game doesn't have any forced hand-holding, and it isn't afraid of the player simply exploring it at his own pace (even if it means circumventing chunks of the experience)."

Microsoft Kinect With World of Warcraft 80

An anonymous reader writes "Researchers at the University of Southern California Institute for Creative Technologies have developed software that enables control of PC video games using the Microsoft Kinect sensor. Their toolkit, known as the Flexible Action and Articulated Skeleton Toolkit (FAAST), emulates custom-configured keyboard controls triggered by body posture and specific gestures. This video shows a user playing the online game World of Warcraft using the Kinect. Potential applications of this technology include video games for motor rehabilitation after stroke and reducing childhood obesity through healthy gaming."

GoldenEye Source Conversion Mod Released 105

Well, this Half-Life 2 mod called GoldenEye Source, five years in the making, has just come out of beta and been fully released for free. The game is a creation of fans with the objective to bring the original experiences from GoldenEye on the N64 back to life. I remember spending hours upon hours playing GoldenEye on the N64, and was sad seeing it go."

Kentucky Announces Creationism Theme Park 648

riverat1 writes "On December first, Kentucky Governor Steve Beshear announced that a creationism theme park is expected to open in 2014. Park developers are seeking state tourism development incentives and could receive up to $37.5 million over a 10-year period. Gov. Steve Beshear said he does not believe the incentives would violate the principle of church-state separation because the 14-year-old tax incentives law wasn’t approved for the purpose of benefiting the Ark Encounter. The park will have a 500 foot replica of the Ark with live animals on it and a Tower of Babel explaining how races and languages developed. The park will be turned over to Answers in Genesis after it is built. They are a non-profit organization which may allow them to discriminate in hiring on the basis of religion."

Pumpkin Pie increases Male Sex Drive 173

Dr. Alan Hirsch, Director of Chicago's Smell and Taste Treatment and Research Center, says the key to a man's heart, and other parts, is pumpkin pie. Out of the 40 odors tested in Hirsch's study, a mixture of lavender and pumpkin pie got the biggest rise out of men ages 18 to 64. That particular fragrance was found to increase penile blood flow by an average of 40%. "Maybe the odors acted to reduce anxiety. By reducing anxiety, it acted to remove inhibitions," said Hirsch.

Viacom To Sell Rock Band Creator Harmonix 112

UgLyPuNk tips news that Harmonix, the game developer behind Rock Band and the early Guitar Hero games, will be sold by parent company Viacom, signaling the media conglomerate's exit from the console game market. Quoting Wired: "The news is yet another ominous sign for the music-game business, which exploded seemingly overnight in 2005 with the release of Guitar Hero. ...sales have been in free fall since the dizzying heights of 2008, with Guitar Hero: Warriors of Rock moving only 86,000 copies in its first week... Thus far in calendar year 2010, the balance sheet seems to show that Harmonix has been a $300 million liability for Viacom. And it doesn’t look like Viacom believes in the long-term future of music games. With any luck, the company will find a buyer that can help Harmonix grow, but it’s hard to imagine a better partner in the music biz than MTV."

I was really surprised to see a post about Hatsune Miku on Slashdot today. I run a worldwide digital music store for Japanese music called HearJapan. We work directly with Crypton Future Media and have released over 300 vocaloid releases. I sell a lot of Japanese music but I think vocaloid is the most interesting. From a business perspective it is great because all of the musicians who write music for vocaloid are amateur musicians and most of them come from the DTM scene (desktop music scene). Because of the popularity of Hatsune Miku the music they create using her voice sells amazingly well. To my knowledge, vocaloid music is the only music that an artist can make and expect to sell a good amount of music without any massive financial backing and a huge corporate orgy. They also embrace a community sharing culture where the song creators will upload their unmastered songs to sites like nico nico douga and have people rate them. They choose the best songs, get them properly mastered and then sell the songs. I also love it from a creative perspective because they write the lyrics through the perspective of these anime characters so there is a lot of creativity. The music itself is incredibly creative and can range from chiptune, to traditional Japanese or from electropop to heavy metal, or from shoegaze to house music. There is a wide variety and for users who haven't heard of this before I recommend you check it out at my site. I am the president of a digital music store specializing in Japanese music called HearJapan. I see piracy destroy my sales on a constant basis. It's difficult getting high sales when most of your customer base are rabid internet users who got introduced to Japanese music through illegal downloads. I actually ran an interesting experiment two years ago that serves as a good example.
