I see the various forums sort of like a public space in a town. And Facebook etc act as the town administration, law enforcement, etc. IT should not be that the town is liable for what people decide to say, but they are liable to provide the infrastructure to deal with it, e.g. clear rules, enforced in an adequate way, ways to complain / litigate individuals etc.
