Algorithmic regeneration on the fly, irt stimuli, is more sustainable than survivor reproduction? Energy system capable to support a response to at least one system detectable stimuli seems to be the most basic definition of life. A self organized energy system which responds in predictable ways to system detectable stimuli, meets the basic defintion of life because it consumes, uses or produces energy, it responds to stimuli, it exist as a consequence of stimuli, and its algorithm for organization irt stimuli provides for its sustained geneation to generation presence (reproduction) ( algorithmic generation is a form of reproduction; survivor reproduction is the form we understand) on the spot self organization might turn out to be more sustainable than individual to indivudal survivor reproduction.

Its not about protecting ip, its about denying and blocking independent access to competition within "commercial space". The EPA laws deny and block independent competition in the chemistry, manufacturing and mineral extraction commercial spaces. The FDA laws deny and block independent competition in the pharmaceutical discovery, production, and market development commercial spaces. The FCC laws deny and block independent competition in the airway communication spaces. The SEC laws deny and block independent competition in the banking and finance commercial spaces. The HS laws deny and block independent competition in the security commercial space. The insurance authorities deny and block independent competition in the insurance commercial space. The Lawyer authorities deny and block independent competition in the legal commercial space. The Physicians and other medical professions and authorities deny and block independent competition in their respective commercial spaces. Its the same world wide, the power of the state is used to monopolize the commercial space. The monopoly of commercial space accounts for the difference between freedom in America in the 1950s and cohesive containment in 2012 and it also explains why the college degree has become so important, because it too is a constraint on competition in the commercial space. So these IP laws and international treaties are not to protect privacy, but to deny access to commercial space and to monopolize portions of said space.

There is an implicit assumption in the theory of democracy that is much forgotten? The full and fair disclosure assumption and the obligation of government to provide relevant knowledge, information, and technology [kit] to every citizen and to engage every citizen in sufficient informative and interactive activity to enable the citizen to discover the real meaning and impact of the decision under consideration. The Citizens in a democracy must have information, dialog, and interaction in order to form relevant opinions, to develop relevant needs, and to impose relevant caveats and wants, etc.. The decision of the governors must reflect the decision of the majority of the corpus of the governed. Democratic participation requires a fully informed public, interactive fully participative debate, and the debate must concern the issues to be decided and must identify the options, problems, risks and advantages involved in the decision should one be implemented. The majority view must be generated by a well grounded, real and measurable majority of the governed. When a vote is taken or a decision is made by the governors, to be democratic, it must reflect the determination made by the majority of the corpus of the governed. In the days before the Internet it might have been argued the duty to extract informed opinion from the corpus of the governed was beyond reach. Each meeting of congress produces decisions about which the public has never heard and engages activities which the governed may not approve. Production personal [law maker] in factories [government] would argue quality control is not necessary. The field of quality control in government is called "Democratic Assurance". What allows the power of constitutional republican governments to be used to give favors, pick winners, etc. is that the lawmakers and decision makers can ignore and avoid the duty to disclose and engage Citizen-Americans in active, heated, dialog and debate.

Nearly always, commercial laws, such as copyright, patent laws, license of parts of the public commons [air ways and right of ways, etc.] can be traced to private interest seeking to use government as a weapon against competition. Such are designed to stop or impede competition, or advantage one competitor over another. The British passed a number of laws that inhibited legal conduct of maritime transported business with British colonies to Ships of British Registry. The only religion these laws encountered were fostered by the get rich schema gods of which there were many.

Copyright is use by entrenched interest of the rule making power of the state to block independent competition from participating in commercial space. Everyone wants to monopolize the commercial space of a nation? In a state that has a government that protects its commercial space by its rule of law powers "independent entrepreneurial competition" is effectively denied. It might be difficult at the corporate level to work with the open source gpl license, but it is impossible for independents to work with the corporate copyright monopolies. The loss damage expectation to "infringement risk" makes the difference. A large corporate fictitious person can absorb the loss (hence take the risk) of an infringement action but a new startup, or independent developer, will usually find the legal cost alone to be terminal.

The framers of the constitution designed-into its bosom: protection to those who engaged in commercial corruption. Those who wrote it, intended it so, it was their way, back them. The real failures in the constitution are two: both pointed to by the article: 1. failure to include, provide for and deliver to every human citizen- American full and fair disclosure about the activities of the humans that operate in or for USA, Inc. (DBA Constitutional Government), and 2. failure to provide the governed human Citizen-Americans an independent [of the USA, Inc. scope and authority], an exclusive right of the governed human citizen-American to investigate, depose witnesses, charge, indite, prosecute, convict and punish those persons[human or corporate] acting in, or for, or under color of our government. In other words, if the governed, who are subject to the government, watch-dogged, those who run the government or who contract with those who run the government: the interest the government serves would be better balanced between democracy and commerce. The theory of democratic assurance is that oversight by the governed is required to preserve the integrity of those who represent the governed. Oversight is different from socialism because oversight does not empower the governed to direct the government, but proper oversight would empower the governed to protect democratic integrity and to prevent corruption or abuse by those who operate or contract with the government.

Most Americans and small businesses cannot afford the gate prices to see the articles written by the scientists and contributors in the different fields of research. Gating has hidden from view and made practicably unaccessible articles that only a few years ago were important parts of research This is true even when the research is funded by government or an exempted by their public purpose from tax organization. That "same beast" is the constitution of the United States of America? That beast is the corporate charter which authorizes the USA, Inc. d/b/a Government and that corporate charter is known as the constitution. Remember the colonies were corporations. Suppose we look to the real problem.. Instead of the sitting government and its persons, and the propaganda that focuses Americans wrongly on two divisions of folks of the same persuasion, lets look at the constitution and its faults. Blame the basic document that encourages the corruption that constitutes the two party system. One thing the America Republic system has is a basic document to go by. 230 years since the Declaration of Independence allows to revisit our system of governance. The contents of the constitution dictate the government, not the governed people of the land, their vote, or the court or anyone else. If there is a problem it should be discoverable within the expressions found therein, or in paragraphs it is missing. One thing I think I found is that the constitution can only be modified in one of two ways: neither of which permit the govern to modify it. I think that needs to be changed.

Centos 6.2 outperforms xp and http://gambas.sourceforge.net/en/main.html works like visual basic on Linux.. Its better than visual basic and with very little modification existing vb type programs run on it. Centos works with server version and desktop on large and small systems. and it is free for the downloading.. why prey tell would you pay for something that does not out perform free? The nice part of open source is it upgrades automatically..

Comment Hidden "knowledge monopolies" allows feudalism (Score 1) 116

Only a few researchers in each field need publish the findings of their field in order to quash the information hiding and distribution restricted activity which has created a "monopoly of knowledge". The players include the mega -corporate global feudal lords, the universities seeking to profit from government research findings, the insider publishers, the law makers, etc. This lock up the knowledge of science program behind closed high priced right person gated doors of copyright has transformed our supply/demand economy capitalism into supply side only feudalism. Instead of serendipity generating competition, our government, by its laws, has turnicated competition and create global mega sized corporate feudal estates and transformed those non monopoly holders into serfs if they work for the global mega sized corporate feudal estates or paupers if they don't. Remember monopoly is a product of the rule of law. Monopoly cannot exist without a government, commerce corrupted government officials and the use of the government's force to impose its anti-competitive laws against would be commercial competitors. Copyright is being used to terminate or severely limit the distribution of scientific knowledge unless the user has great big pockets and this condition plays a big part for the accumulation of inventories of tax-free monopolies enjoyed the few mega corporate feudal lords. The global mega sized corporate feudals use monopoly inventories, copyright, patent and license of parts of the public commons, to inhibit competition. Without competition there is no capitalism instead it is feudalism. The Internet would never have developed had it been subjected to the copyright and patent monopolies current law has imposed. Its impact is felt everywhere in the development of equipment, in the development of software, in gaining access to the public markets, in the learning environments, etc.. Everywhere monopoly exists it inhibits competition and without competition there is feudalism.
