Submission + - Interpreting The Constitution In The Digital Era (npr.org)

oik writes: NPR's Fresh Air this week had an interesting interview with Jeffrey Rosen, one of the authors of Constitution 3.0 which addresses a number of issues to do with interpreting the US Constitution in the face of new technologies (both present an future). Many of the topics which he touches on come up on Slashdot a lot (including the GPS tracking cases). It's well worth listening to the program (link in the main page), of which TFA is just a summary.

Licensing an Abandonware Game? 148

WolverineOfLove writes "I'm recreating a 1980s abandonware game with copyrights that have been seemingly unused for the past 18 years. The situation is detailed further in a Slashdot journal entry I just wrote, but in short: Is it worth dealing with all the copyrights and paying money if I want to recreate an abandonware title as an open source game? I know there are legal implications to certain decisions I might make, but there is a real possibility that this game's copyright holder will do nothing with the rights, and I'd much prefer preserving it for others than letting it fade away."

Seinfeld's Good Samaritan Law Now Reality? 735

e3m4n writes "The fictitious 'good samaritan' law from the final episode of Seinfeld (the one that landed them in jail for a year) appears to be headed toward reality for California residents after the house passed this bill. There are some differences, such as direct action is not required, but the concept of guilt by association for not doing the right thing is still on the face of the bill."

Heavy Rain Previews Show Promise 84

As the February release date for Quantic Dream's Heavy Rain nears, several publications have gotten a chance for some hands-on time with the game and seem to be intrigued by what they saw. Quoting the Opposable Thumbs blog: "The game grabs you during the quiet moments where nothing 'happens.' When you look at a picture your child drew. When you're questioning someone about a crime. When you're trying to figure out how to react to a violent situation. The preview we were sent put me in different situations as I played a small handful of characters, and each one provided a few tiny moments that were surprising in terms of storytelling or subtlety." Eurogamer's previewer had a similar reaction: "To my great delight as well — Heavy Rain isn't a mature game because it has unhappy families and moody lighting, it's a mature game because it anticipates an adult response from the player and is prepared to receive it."

94 New Species Described By CA Academy of Sciences 52

An anonymous reader writes "Researchers at the California Academy of Sciences traversed four continents and two oceans to uncover 94 new species in 2009, proving that while sometimes in this digital age the world can feel like a small place, much of it has yet to be explored. Among the 94 discoveries were 65 arthropods, 14 plants, 8 fishes, 5 sea slugs, one coral, and one fossil mammal. Why does it matter? As Dr. David Mindell, Dean of Science and Research Collections at the Academy, explained, 'Humans rely on healthy ecosystems, made up of organisms and their environments. Creating a comprehensive inventory of life on our planet is critical for understanding and managing resources. Yet a great many life-forms remain to be discovered and described.'"

The Psychology of Achievement In Playing Games 80

A post on Pixel Poppers looks at the psychological underpinnings of the types of challenges offered by different game genres, and the effect those challenges have on determining which players find the games entertaining. Quoting: "To progress in an action game, the player has to improve, which is by no means guaranteed — but to progress in an RPG, the characters have to improve, which is inevitable. ... It turns out there are two different ways people respond to challenges. Some people see them as opportunities to perform — to demonstrate their talent or intellect. Others see them as opportunities to master — to improve their skill or knowledge. Say you take a person with a performance orientation ('Paul') and a person with a mastery orientation ('Matt'). Give them each an easy puzzle, and they will both do well. Paul will complete it quickly and smile proudly at how well he performed. Matt will complete it quickly and be satisfied that he has mastered the skill involved. Now give them each a difficult puzzle. Paul will jump in gamely, but it will soon become clear he cannot overcome it as impressively as he did the last one. The opportunity to show off has disappeared, and Paul will lose interest and give up. Matt, on the other hand, when stymied, will push harder. His early failure means there's still something to be learned here, and he will persevere until he does so and solves the puzzle."
