The MPA (Motion Picture Association) trial against Newzbin.com, a website that indexes NZB files and content on the newsgroups, will begin in London on Monday. Will lightning strike twice in favor of website indexing?" Torrentfreak points out one major difference between the cases: "Ellis’s charge was one of fraud, allegedly conducted by an individual and dealt with under criminal law, while that leveled against Newzbin is one of allowing and inducing illegal copying, i.e copyright infringement, but carried out by a bona fide company under civil law."

CWmike writes "Mozilla has shipped a release candidate build of Firefox 3.6 that, barring problems, will become the final, finished version of the upgrade. Firefox 3.6 RC1, which followed a run of betas that started in early November, features nearly 100 bug fixes from the fifth beta that Mozilla issued Dec. 17. The fixes resolved numerous crash bugs, including one that brought down the browser when it was steered to Yahoo's front page. Another fix removed a small amount of code owned by Microsoft from Firefox. The code was pointed out by a Mozilla contributor, and after digging, another developer found the original Microsoft license agreement. 'Amusingly enough, it's actually really permissive. Really the only part that's problematic is the agreement to "include the copyright notice ... on your product label and as a part of the sign-on message for your software product,"' wrote Kyle Huey on Mozilla's Bugzilla. Even so, others working on the bug said the code needed to be replaced with Mozilla's own."

Responding to a Freedom Of Information Act request, the US government has revealed the operating costs of the America's Army game series over the past decade. The total bill comes to $32.8 million, with yearly costs varying from $1.3 million to $5.6 million. "While operating America's Army 3 does involve ongoing expenses, paying the game's original development team isn't one of them. Days after the game launched in June, representatives with the Army confirmed that ties were severed with the Emeryville, California-based team behind the project, and future development efforts were being consolidated at the America's Army program office at Redstone Arsenal in Alabama. A decade after its initial foray into the world of gaming, the Army doesn't appear to be withdrawing from the industry anytime soon. In denying other aspects of the FOIA request, the Army stated 'disclosure of this information is likely to cause substantial harm to the Department of the Army's competitive position in the gaming industry.'"

An anonymous reader writes "Ben Kuchera from Ars Technica is reporting that EA/DICE has substantially changed the game model of Battlefield: Heroes, increasing the cost of weapons in Valor Points (the in-game currency that you earn by playing) to levels that even hardcore players cannot afford, and making them available in BattleFunds (the in-game currency that you buy with real money). Other consumables in the game, such as bandages to heal the players, suffered the same fate, turning the game into a subscription or pay-to-play model if players want to remain competitive. This goes against the creators' earlier stated objectives of not providing combat advantage to paying customers. Ben Cousins, from EA/DICE, argued, 'We also frankly wanted to make buying Battlefunds more appealing. We have wages to pay here in the Heroes team and in order to keep a team large enough to make new free content like maps and other game features we need to increase the amount of BF that people buy. Battlefield Heroes is a business at the end of the day and for a company like EA who recently laid off 16% of their workforce, we need to keep an eye on the accounts and make sure we are doing our bit for the company.' The official forums discussion thread is full of angry responses from upset users, who feel this change is a betrayal of the original stated objectives of the game."

Rossy's next goal is to cross the Strait of Gibraltar, from Tangier in Morocco and Tarifa on the southwestern tip of Spain. Mr2001 writes "Consumerist reports that Apple is refusing to work on computers that have been used in smoking households. 'The Apple store called and informed me that due to the computer having been used in a house where there was smoking, [the warranty has been voided] and they refuse to work on the machine "due to health risks of second hand smoke,"' wrote one customer. Another said, 'When I asked for an explanation, she said [the owner of the iMac is] a smoker and it's contaminated with cigarette smoke, which they consider a bio-hazard! I checked my Applecare warranty and it says nothing about not honoring warranties if the owner is a smoker.' Apple claims that honoring the warranty would be an OSHA violation. (Remember when they claimed enabling 802.11n for free would be a Sarbanes-Oxley violation?)"

The uniform features a dedicated pocket that can store the phone and make it safe for those who wear it.'"
