Besides have a bunch of evil lawyers on retainer, the obvious reason Hearst went after Mandrakesoft was to get mandrake.com. You see, they have another lousy movie on the way out and it is a whole lot easier to promote mandrake.com then mandrakethemagician.com.
It is easy to see what happened here. Tuxedos are associated with penguins and also magicians. This association is incidental and they should not have been fined for this.
