First off, I'm not normally one to defend MS.....
The only difference between what Microsoft did with TCP/IP and ftp is really not any different than what Red Hat or any other commercial Linux distro does with any of their programs. Sure, they don't provide access to the source, but they're not required to under the BSD license.
