Remember a while back, when DOSEMU needed a special kernel hack to get all the features ?
Linus wouldn't put their hack into the kernel because he found the patch a bit dangerous. The patch later on became a special module, and later on again is wai incorporated into the kernel.
The same thing will happend this time.
The other tactic to GPL (or another opensource licence) the old version is also a well known tactic. Look at ghostscript and DOOM.
So don't be afraid. This is good for Linux.
