theodp writes "The NY Times reports that Google and Intel have teamed with Sony to develop a platform called Google TV to bring the Web into the living room through a new generation of TVs and set-top boxes. The three companies have tapped Logitech for peripheral devices, including a remote with a tiny keyboard. Based on Google's Android operating system, the TV technology runs on Intel's Atom chips. Google is expected to deliver a toolkit to outside programmers within the next couple of months, and products based on the software could appear as soon as this summer."

Modded Xbox Bans Prompt EFF Warning About Terms of Service 254
Last month we discussed news that Microsoft had banned hundreds of thousands of Xbox users for using modified consoles. The Electronic Frontier Foundation has now pointed to this round of bans as a prime example of the power given to providers of online services through 'Terms of Service' and other usage agreements.
"No matter how much we rely on them to get on with our everyday lives, access to online services — like email, social networking sites, and (wait for it) online gaming — can never be guaranteed. ... he who writes the TOS makes the rules, and when it comes to enforcing them, the service provider often behaves as though it is also the judge, jury and executioner. ... While the mass ban provides a useful illustration of their danger, these terms can be found in nearly all TOS agreements for all kinds of services. There have been virtually no legal challenges to these kinds of arbitrary termination clauses, but we imagine this will be a growth area for lawyers."
Chinese Court Rules Microsoft Violated IP Rights 237
angry tapir writes "A Beijing court has ruled that Microsoft violated a Chinese company's intellectual property rights in a case over fonts used in past Windows operating systems. The Beijing Number One Intermediate People's Court ordered Microsoft to stop selling versions of Windows that use the Chinese fonts, including Windows XP. Microsoft plans to appeal the case. Microsoft originally licensed Zhongyi's intellectual property more than a decade ago for use in the Chinese version of Windows 95, according to Zhongyi. Zhongyi argues that agreement applied only to Windows 95, but that Microsoft continued to use the intellectual property in eight versions of Windows from Windows 98 to Windows XP. Vista and Windows 7 are not involved."
NASA Willing To Team With China; Rumors of a Budget Cut 200

So it's perhaps no surprise that NASA has publicly stated that they are ready to team up with China. NASA Chief Charles Bolden said, 'I am perfectly willing, if that's the direction that comes to me, to engage the Chinese in trying to make them a partner in any space endeavor. I think they're a very capable nation. They have demonstrated their capability to do something that only two other nations that have done — that is, to put humans in space. And I think that is an achievement you cannot ignore. They are a nation that is trying to really lead. If we could cooperate we would probably be better off than if we would not.' While the budget of the China National Space Administration is a fraction of NASA's, partnering with them has been considered since 2008. In possibly related news, rumors are circulating of the Obama administration cutting NASA's budget by ten percent for fiscal year 2011 despite the success of Monday's Atlantis launch. Considering the Augustine panel's recommendations, such a cut could halt US human space flight for a decade."

They've worked for it, so they have every right to do what they want. If a teacher writes a book and sells it via a big name publisher, it's legit, but if they do it online, it's not?
Some of the teachers who taught me had written material that were way better than the books that were recommended for us. If they make a living out of it, why not? Teaching is a low paying job. Might as well make money on the side.
But, as the article says, if people are buying preschool lessons, then it's just lazy parents. Do you really need external lessons to teach your kid to be good at preschool?

Doctorow says that one of the things that makes their ISP Priority Colo so awesome is that they don't automatically act on DMCA takedowns and proceeded to dare Lauren to sue. 'This is classic fair use: a reproduction "for purposes such as criticism, comment, news reporting," etc,' writes Doctorow. 'Copyright law doesn't give you the right to threaten your critics for pointing out the problems with your offerings.' Doctorow adds that every time Lauren threatens to sue he will 'reproduce the original criticism, making damned sure that all our readers get a good, long look at it,' 'publish your spurious legal threat along with copious mockery,' and 'offer nourishing soup and sandwiches to your models.'"

Removing one ear bud will pause the music. Removing both ear buds will stop the music. Both ear buds have to be in your ear to play the music. According to Sony Ericsson, this will allow you to 'play your music and answer phone calls just by inserting the buds into your ear or taking them out.'"
Atari 1200XL Stacked Up Against a Dell Inspiron 253
Bill Kendrick writes "My first computer was the short-lived 1200XL model of the Atari 8-bit computer line. I finally got ahold of one again, after having to settle with a lesser Atari system. My immediate reaction was: 'Damn, it's as big as my Dell Inspiron laptop!', and I couldn't resist doing one of those side-by-side comparisons, complete with photos of one system sitting atop the other. (I also put the 1983 storage and speeds in 2009 terms, for the benefit of the youngin's out there.) While in many ways the Atari pales in comparison to the latest technology they cram into laptops, I do get to benefit from SD storage media. It also still boots way faster than Ubuntu on the Dell, has a far more ergonomic keyboard, and is much more toddler-proof."

UK Police Told To Use Wikipedia When Preparing For Court 180
Half-pint HAL tips news of UK prosecution lawyers who are instructing police to study information on Wikipedia when preparing to give expert testimony in court.
"Mike Finn, a weaponry specialist and expert witness in more than 100 cases, told industry magazine Police Review: 'There was one case in a Midlands force where police officers asked me to write a report about a martial art weapon. The material they gave me had been printed out from Wikipedia. The officer in charge told me he was advised by the CPS to use the website to find out about the weapon and he was about to present it in court. I looked at the information and some of it had substance and some of it was completely made up.' Mr. Finn, a former Metropolitan Police and City of London officer and Home Office adviser, added that he has heard of at least three other cases where officers from around the country have been advised by the CPS to look up evidence on Wikipedia."

Stockholm District Court defended the judge's membership in copyright organizations as a necessity to 'keep up with developments in the field' and that merely endorsing the idea of copyright law was not grounds for a mistrial. The defendants must now rely on the appeal process, while one defendant has written on his Twitter account that the PirateBay will also be suing Sweden for human rights violations."
