As qouted below, it does say merchandise, what is it about the software on the CD that doesn't qualify it as merchandise? If it isn't merchandise, what is it?

Soon my brain is about to fry - trying to distinguish between all these definitions - merchandise, intellectual property, accessdevice, service. They are all floating into eachother nowdays and laws and regulations can't keep up. The government really should dump all this terms and use something like - blah blah stuff used to [insert whatever].
