It's both legal and moral. Since Apple is a publicly traded company (and many Australians own Apple shares), they have a LEGAL responsibility to maximize a shareholders return on investment. Simple as that. Like someone else has said, as long as what they do with their income is LEGAL, I say go ahead. If people don't like it - change the laws. Don't piss and moan because someone is *NOT* breaking the law. In any way.

True. But that's not how it works in practice.

What starts as "wanted: experienced C++ programmer", becomes "wanted: experienced C++ programmer with knowledge of mainframe communications protocols and in developing complex financial applications... blah, blah" such that there's only one possible applicant for the job. Even in the rare case where the job application actually received a response, all you have to do is find some other bullshit reason to not employ the person.

The whole H1-B program is pretty much a joke. But then, so is most of our government.

Yes. But they're not.

Letting a company the size of Facebook effectively design immigration policy to the disadvantage of US citizens is actively working against that purpose. That's fraud.

Here in the USA, we have the best government money can buy. If you actually make corporations (and the more wealthy among us) pay their fair share of taxes, they might actually have to lay off one of two members of the house/senate.

At the risk of getting lost in the clutter, I'm gonna post a response... If I were a major MS shareholder or board member, I'd be petitioning the board to fire his ass. Apart from Kinect, what innovative product has MS made in the last 5+ years? They need to come up with something that people WANT, not improvements to something that [they think] they NEED. I hate to compare to Apple, but let's face it. Apple really don't produce anything we NEED. But look at the success they have achieved by producing a bunch o' stuff that people WANT. No one WANTs the latest version of Windows or Office.

Not everything, but no hardware manufacturer has the right to dictate what tools you may and may not use to develop on their platform.

They have every "right". If you don't like it, fuck off. It's as simple as that. Apple clearly publishes a set of rules (and they clearly say that "these rules are subject to change"). Follow the rules and you can (within those rules) do whatever the fuck you like. Break the rules and you can take your own ball and go home.

Thumbs down to M$ for allowing this to happen. I understand that this "hole" has been significantly reduced in Vista - we'll see.

Use of imaging/backup software like Ghost has already been mentioned, but how many people really take system state backups (or for that matter any backups) with any regularity?
