This post clearly shows that someone doesn't understand either the First-sale doctrine or the reason why libraries can lend out books and movies for free. I suggest no one listen to the nonsense he put out. The rental company has no right under the First-sale doctrine to rent the person's video if they had no permission to do so. Since this rental company is also clearly not a library they are not covered under the same protections afforded to such institutions. The AC, if their claim is real, should use his status as the copyright owner to stop this violation of his rights.

An anonymous reader writes: DigitalBurn.com has posted an review of HTC's new X7510 Advantage smartphone. It is technically a smartphone, but looks more like a small laptop since it has a 5" VGA touchscreen display. Other features include tri-band HDSPA 3G data, a 3 megapixel auto-focus camera, a magnetically attached QWERTY keyboard, and a full-blown Opera 9 web browser. It can even be hooked up to a TV or external monitor/projector.

Submission + - RIAA theories shot down in Arizona case (blogspot.com)

NewYorkCountryLawyer writes: "In Atlantic v. Howell, the judge has totally eviscerated the RIAA's theories of "making available" and "offering to distribute". In a 17-page opinion (pdf), District Judge Neil V. Wake carefully analyzed the statute and caselaw, and based on a "plain reading of the statute" concluded that "Unless a copy of the work changes hands in one of the designated ways, a "distribution" under [sec.] 106(3) has not taken place". The judge also questioned the sufficiency of the RIAA's evidence pointing towards defendant, as opposed to other members of his household. This is the Phoenix, Arizona, case in which the defendant is representing himself, but received some timely help from his friends. And it's the same case in which the RIAA suggested that Mr. Howell's mp3's, copied from his cd's, were "unlawful". One commentator calls today's decision "Another bad day for the RIAA"."
