I still remember the morning I looked on slashdot and saw the original announcement that SCO was filing copyright claims against Linux. It's amazing how long how this has been going on, and how much has changed since then (and not just what's changed in SCO's ever-shifting claims!-- that first morning I seem to remember most of the discussion was speculation on what exactly it was that SCO claimed was stolen from them. Years later and I still don't think we ever really found out). The start of this case was so long ago it was like an entirely different world. This case has been going on longer than the Iraq war. This started so long ago that at the time Slashdot was still known for hating Microsoft rather than salivating over the XBox.

This in mind, while it's wonderful that the system showed SCO wrong in the end, I have trouble seeing this really as a loss for SCO. They managed to continue their claims for a good five years-- a significant fraction of the lifetime of Linux itself-- without ever showing a whit of substance to those claims. SCO will die now that their case is lost, but they might have died years sooner and possibly poorer if not for this lawsuit gambit keeping them on life support. Microsoft managed to fund this through weird proxies without one single bit of consequences for themselves, and unlike SCO they will live on.

Linux has now weathered its first major court challenge, but the media coverage of Linux's successes in this case has never quite matched up in amount to the withering and credulous coverage of the baseless PR accusations of Darl McBride's heyday-- though we won in the end, the case may well be a net PR loss. Meanwhile, I don't think Linux is as viable as a movement as it was at the beginning of this case. This for all I know has nothing to do with the SCO case itself, but it seems like five years ago people still thought Linux on the desktop had a future, now I don't hear anyone talking about that anymore. Five years ago linux seemed to be going places, whereas now Linux's situation seems largely static, little progressed from where it was five years ago. Maybe I'm just a pessimist, but I don't really feel good right now thinking about how this entire debacle has gone.

I guess my main response is kudos to PJ of Groklaw for her amazing and tireless journalism throughout this case. I'd be curious to ask PJ what her plans are as to what she's going to do next. In the short term maybe she should write a book about this entire thing.

PS3 Performance Downgraded Again 217

Heartless Gamer writes "The PS3's performance has been downgraded again, according to the Inquirer." From the article: "We can't tell you why the GPU lost nearly 10% of it's clock, it could be an NVidia screwup, or it could be Sony/Cell. Either way, it just became much less of an overwhelming value, but you get a DRM infected drive for 'free' either way." Interesting, but keep in mind this is The Inquirer. 9 out of 10 doctors recommend salt with their articles. Relatedly, the choice comments from Penny Arcade this past weekend about Sony's console are wandering around the internets today. From that article: "We've already talked about it, there's no chance we're buying a PS3 at launch."

Castlevania Retrospective, Xbox Live Bound 59

Although I am looking forward to Portrait of Ruin for the Nintendo DS, I really hope Konami finds a way to release a 2D game for one of the next gen systems." Funny you should mention that. PS3 Production 'In Full Swing' 69

1up is reporting on comments from Phil Harrison, saying that the PS3 is in full production mode. There are apparently already 10,000 devkits out there, and something like 100 games in the pipe already for the console. From the article: "Sounds pretty much like the usual rah-rah, go-team kind of stuff you'd expect to hear before a major system launch, but mentions of third-party support become far more interesting when you learn that many folks, both within Sony and without, are apparently 'scared of the wrath of Phil Harrison,' according to a Guardian source. Are third-party developers as excited and supportive as Harrison would have us believe, or are they just scared of receiving a Sony-flavored beat down?"

Gears of War Ships November 12th 45

Kotaku is reporting that Epic has confirmed a November 12th retail date for Gears of War, the highly anticipated shooter for the Xbox 360. This announcement confirms a date found by individuals participating in a viral marketing campaign via Xbox Live. From the announcement: "'Our vision is to deliver a one-two punch of cinematic action paired with a thrilling and compelling interactive experience,' said Cliff Bleszinski, lead designer at Epic. 'With Gears of War we've created a title that will place gamers directly in the shadows of a ravaged world, surrounded by the beautiful remnants of a destroyed city and the horrific dangers that hide in the rubble.'"

Nintendo's Next-Gen Arsenal 321

Much of the coverage of the next-gen skirmish so far has focused on Sony and Microsoft. The already-impressive Xbox Live vs. the PS3. Just the same, for the first time in many years Nintendo is definitely in the running for top spot. About.com has a piece looking at what the big N is bringing to the next-gen party this November. From the article: "While Nintendo is trend setting with controllers like the Wiimote and, to a lesser extent, the nunchaku dongle, other companies will be following along. Nintendo's game plan from the genesis of the Wii has been touch and gamer-friendly games. They see the future of gaming in the Wiimote. Everyone else, at this point, seems to be just catching up."

Xbox 360 Game Piracy Spreading In China 91

simoniker writes "Xbox 360 game piracy appears to be spreading notably in China, with at least one Shanghai-based vendor offering Xbox 360 titles such as Hitman: Blood Money for around 30 Chinese yuan ($3.50). This comes after hackers managed to flash changes to the BIOS on the Xbox 360's Optical Disc Drive earlier this year, which allowed non-authenticated (copied) games to be played. Microsoft's John Porcaro commented at the time: 'The core security system has not been broken. However, on some Xbox 360 consoles the authentication protocol between the optical disc drive and the console may be attacked.'"

The 360 - Online, Japan, HD-DVD 66

Lots of tidbits about Microsoft's next-gen console floating around this week. On Monday, the company revealed that almost 60% of 360 owners are now using Xbox Live. GameDaily discusses what is making their setup so dang popular. Major Nelson's Sunday podcast included a lot of details on the 360's approach to HD-DVD. HD Beat has the rundown on what was said, including the inevitable Sony smack-talk. Finally, Gamasutra has a feature on the 360's position in Japan. A group of analysts debate whether or not the system even needs Japan in order to be a success. From this last article: "I don't think that American gamers are enamored [with] Japanese product because it comes from Japan; rather, I think Americans like good games, regardless of the country of origin. Microsoft doesn't need Japanese development to succeed in the U.S.; it needs good games, period."

PS3 To Slow Game Industry Growth? 197

simoniker writes "DFC Intelligence's game analyst David Cole has released a new report on the next-gen video game market, and he's especially harsh on PS3 plans: 'The high price of the PlayStation 3 is going to slow overall industry growth, especially for software,' and '...if Sony does not change its current strategy for the PS3 the system will probably end up in third place in installed base.' He also suggests that 'the PS3 would be more than 35% of the monthly household income' of average families in some world territories. When will the backlash end?" The bottom line is that, even if they ramp up to 200,000 units a month starting this month, they're still not going to hit their 2 million unit goal in time for a November launch. Shortages and the high price tag will mean this is going to be a very weird Christmas console season.

What Game Developers Think about DirectX 10 115

mikemuch writes "In the last of his series of interviews with the stakeholders in Microsofts upcoming DirectX graphics API, Jason Cross speaks with the developers of Hellgate, Crysis, Flight Simulator X, and Age of Conan. They seem pretty stoked about the new technology's ability to get visual detail to a much higher level of realism, and to offload physics and AI to the CPU." From the article: "Without hardware, it is hard to evaluate which features will really make the biggest performance impact. The geometry shader looks pretty full of potential. So does the fact that you can write to buffers from any shader and then read them into another shader. Texture arrays look like they will make a big dent our batch count, which should lead to much better frame rates. At this point I feel like I'm looking at a shiny new toy through a shop window: I can't wait to get my hands on it and play with it, but I don't really know what it can do."

Playstation 3 Soon Into Production 220

Roy van Rijn writes "According to Forbes, the Commercial Times reported that Taiwanese ASUSTeK Computer Inc. will be delivering PlayStation 3 consoles to Sony starting this month. The news comes amid concerns that Sony may not have enough Cell and RSX chips to meet production goals of 2 million units for launch. The report also states that, Hon Hai Precision Industry Co Ltd, also a Taiwanese company, will soon begin making the PlayStation 3 consoles for Sony too. Total monthly shipments from manufacturers are expected to be 200,000 units per month."

Sony's Harrison on Sony Arrogance 136

Joystiq had the chance to exchange a few words with Sony's Phil Harrison at the UK Develop Conference. They asked him some hard questions about the crazy comments that have been coming out of the company since E3. From the article: "There's always going to be a risk when you are market leader for ten years that we start to lose perspective; and we have to make sure that we don't lose perspective. But I don't think we're arrogant, I think we have to recognize that we're in a highly competitive industry and that anything that we say will be eternally editorialized by professionals and consumers alike. So we're always in the spotlight." After the tape was off he snarked that he hadn't been asked very nice questions. Poor guy, having to answer questions that aren't 'How awesome is the PS3 going to be?'

Sony 'Anti-Used Game' Patent Explored 435

Sometime in 2000, Sony patented a process that would 'verify a disc as legitimate, register the disc to that particular game console, then wipe out verification data so the disc would be rendered unreadable in other PlayStations'. Despite unrest in the gaming community over this technology, the company has repeatedly stated they have no plans to use it in the PS3. The LA Times explores this persistent debate, examining why Sony developed the tech and why gamers are nervous. From the article: "Whatever Sony's plans, the tempest [over the patent] illustrates the changing nature of ownership as millions of people accumulate vast collections of digital entertainment. Few people realize that when they buy software or music or movies, they are actually buying a license to use, watch or listen. It's been used to create some extraordinary visuals in tiny packages, like .kkrieger, which is less than 96 Kilobytes big but still has graphics that look like like a modern PC title. Beyond that, there's even more that Procedural Synthesis might be able to do; what if your old video games never aged, never looked out-of-date? Imagine putting Halo 2 into your Xbox 360 only to have it automatically upgraded to look like Halo 3 in graphical quality.
