You can't sue the phone company for things people say on their network, because they are a common carrier - they exert no editorial influence on what is said on their network.
You can sue a newspaper because they DO exert editorial rights over the content.
However dot coms get the protection of a common carrier while exerting editorial rights over the content. A better way is for them to determine which way they want to be considered, and then live with the results of that choice. That way their 1st amendment rights are still able to be protected, but they don't get to shirk responsibility. Or, they let everyone else's free speech happen and they are absolved from liability. None of this cake-and-eat-it stuff.
