Funny thing - I too have a first gen iTouch (Lennon Legend on the front of the box) and staring at the box as I type, I see no mention of any free software updates. It does however say "Song not included."

Why oh why is this +5 insightful? I think the term exclusive was meant in the sense that only the iTMS has the recorded version of the live set. I didn't read it as anything to do with being in the "in crowd".

While I don't have the experience to comment on the first half of your message, this part:

I have to disagree with. While AFS is certainly a pile of crap in OS X experience tells me that native SMB in Mac OS X is indeed a larger pile of crap than AFS.
