They didn't have your identity, they only had your DNA. With the genetic testing services now they have you, whether it was your DNA or your family's DNA with the testing service.

Let's say someone gets killed or raped in a place you once innocently visited, and because you touched something, smoked a cigarette, drank a soda, etc your DNA was left behind. Police and prosecutors aren't very discriminating in who they pin a crime on, just that they want someone for the crime and they have your DNA. Now you need to hire a lawyer and defend yourself. Can't afford one or the one you have isn't very good? To jail you go, criminal.
