I doesn't really matter if the work is out of copyright. If someone has already posted the work on youtube (for example) then it is that poster who is able to claim it as their own, if they so wish, regardless of the law.

And because YT infringement rules ask the _original poster_ to confirm they own the copyrights (but not verify the case in law) it's impossible to use/remix the content without fear of copyright strikes. (Guess who gets to oversee the appeal of a copyright claim? Yep - the original poster/claimant!)

This happened with the out-of-copyright 1922 "Trip to the moon".
