You are confusing the Board of Patent Appeals and Interferences (BPAI) and the Court of Appeals for the Federal Circuit. The Federal Circuit handled the cases that are linked in your post.
There is no question that Federal Circuit judges are constitutionally appointed, Article III (i.e. Judicial Branch) judges that were appointed by the President and approved by Congress. The BPAI "judges" are Administrative Judges that fall under the Patent Office's organization in the Executive Branch. They handle appeals from patent examiner rejections or interferences between two similar patent applications.
