Comment Strong Legal Right (Score 1) 231

what gives companies a âoestrong legal rightâ to sensor speech?

âoe Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievancesâ

So wouldnâ(TM)t any law that allows companies to restrict free speech be unconstitutional? It doesnâ(TM)t say anything about who can censor. It says congress canâ(TM)t make a law that results in censorship.

or is it lack of a law that allows for it? I wouldnâ(TM)t consider that strong legal right.

Comment Compatibility (Score 1) 85

The government should require a minimum compatibility, like for example every OS should support a common interpreter that allows for cross-platform apps. They can have other stuff too that allows innovation, meaning developers are not force to use the common interpreter. And the common interpreter could evolve or be replaced with a better common interpreter, but this would require some standards organization to manage this. There should be common file formats that have to be supported. Other formats could be used as well though to allow for innovation and it's the users choice if they want to use standard formats or not. There should be common protocols for things like video chat and texting. Other protocols could be used as well, but there is no reason that apps, communication, and files should not be able to be used cross platform. Just an idea, but if this could be done, it would solve a lot of problems. Innovation is currently used as an excuse to create user lock-in and it should not have to be that way. User lock-in can lead to anti-trust issues, and it is also bad for consumers.

Apple iphone isn't a monopoly in the phone market, but the apple app store is a monopoly in the iOS app market. There are no competing app stores that sell apps for iOS (because Apple blocks it). The apple app store has 100% market share of iOS apps, which is a market for 3rd party products.

Apple may not have a monopoly over mobile device sales, but they do have a monopoly over app sales on iOS.

Monopoly is defined as:
"Exclusive control by one group of the means of producing or selling a commodity or service.
n. A company, group, or individual having exclusive control over a commercial activity."

It doesn't say anywhere in that definition that is has to be a physical product or that there can't be similar products or services. By defintion, Apple absolutely does have a monopoly and they gave it to themselves not through competition and beating out other companies, but in an illegal way.

Customers shouldn't have to go to another brand of device (where there is only one other option that they may still agree with even less) just to avoid Apple's illegal business practices. Apple should not be doing illegal stuff.

If the government decides it is ok for Apple to do this, Microsoft should be free to do the same on their platform. It would mean the end of Uplay, Steam, Epic, GoG and every other seller of pc software. Everything would be purchased on microsoft store with a 30% microsoft fee. No more Stream sales. Make no mistake, ios is a computer operating system. The form factor of the computer it runs on is the only difference.

They are free to choose their business model as long as it is within the law. It may not be. Itâ(TM)s not that simple to say just donâ(TM)t buy their product if you donâ(TM)t agree with their policies. There are only two options and a lot of people donâ(TM)t agree with the practices of either one. so then what? People should just not have a phone? No, people just accept the crap because they feel like they have no choice. That is when itâ(TM)s time for their elected officials to step in.
