But the bill as it reads applies only to "encoding and transmission" of data - which presumably does not affect backend systems, right Birkieboy? If so, then as long as you can cough up the data in an open format for public consumption, no worries.
OTOH, if it's meant to apply to backend systems, then the author is clearly nuts.
