NewYorkCountryLawyer writes: "The RIAA has been ordered to turn over its attorneys' billing records by March 26, 2007, in Capitol v. Foster in Oklahoma. The 4- page decision and order, issued in connection with the determination of the reasonableness of Ms. Foster's attorneys fees, requires the RIAA to produce the attorneys' time sheets, billing statements, billing records, and costs and expense records. The Court reviewed authorities holding that an opponent's attorneys fees are a relevant factor in determining the reasonableness of attorneys fees, quoting a United States Supreme Court case which held that "a party cannot litigate tenaciously and then be heard to complain about the time necessarily spent by his opponent in response" (footnote 11 to City of Riverside v. Rivera)."

Submission + - Cisco and Apple call iPhone truce

Rob writes: Cisco Systems has called its legal attack dogs off Apple, saying that the two companies have agreed that they can both use the iPhone brand to market their telephones. The deal includes a vague agreement to "explore opportunities for interoperability in the areas of security, and consumer and enterprise communications". The settlement is an obvious boon to Apple, which was hoping to leverage its successful iPod brand to sell its take on "iPhones", which will play music and video and provide internet access as well as making calls. A potentially ugly lawsuit has been avoided. It's also quite useful to Cisco, which gets to associate its distinctly less sexy devices with what may turn out to be a successful Apple branding campaign.

blu3 b0y writes: The San Francisco Chronicle is reporting that new post-9/11 information sharing agreements have made it as easy for a Canadian border officer to know the full criminal records of US citizens as it is for their local police. As a result, Canadian officials are turning away American visitors for ancient minor convictions, including 30-year-old shoplifting and pot possession convictions. Officials claim it's always been illegal to enter Canada with such convictions without getting special dispensation, they just had no good way of knowing about them until recent security agreements allowed access. One attorney speculates it's not long before this information will be shared with other countries as well, causing immigration hassles worldwide.
