I think the difference in this case, is that they *are* using the GPL, but adding stipulations beyond it (i.e, no binary releases.)
I happen to follow MPlayer development for a while now and I can't agree. AFAIK, they never forbidden to release binaries. It was just a suggestion that it would have been illegal to distribute them.
Among other things, the developers were pissed off because there wese binary Debian unstable packages available before they made the source tree GPL compliant (as they claim they did).
