In a free market competition drives the market price down to cost. The fact that there is such a difference between what Time Warner is charging and what this city is charging just shows how little competition there is in that market. Just because none of the other cable companies that all enjoy their own monopoly or duopoly status in whatever markets they operate in don't charge these prices, that doesn't mean they aren't the true market price of the services.

Time Warner is trying to protect the _lack_ of competition they enjoy by trying to bribe the state government to ban this local government run utility that forces competition. They want their monopoly status and the ability to set their own price point back, and bribing for a law is well worth the money if it works.

Now if the issue was that Time Warner wanted to lease some of that fiber and start competing in that market (had they not already been established there) and were denied then the situation would be different. In that case one could certainly argue that the local government is being socialistic while blocking any sort of capitalistic competition from entering the market.

One could still argue that the local government is being socialistic, but that is beside the point. Introducing a competitor in a monopolistic market is exactly the type of things we _want_ our government to be doing. Granting one or two companies sole ownership of a market and then saying that "competition will work everything out" is a ridiculous argument to use in favor of _not_ adding competition.

Followup To "When Teachers Are Obstacles To Linux" 626

An couple of anonymous readers wrote in to let us know about a followup to last Wednesday's story of the teacher who didn't believe in free software. The Linux advocate who posted the original piece has cooled off and graciously apologized for going off half-cocked (even though the teacher had done the same), and provided a little more background which, while not excusing the teacher's ignorance, does make her actions somewhat more understandable. Ken Starks has talked with the teacher, who has received a crash education in technology over the last few days — Starks is installing Linux on her computer tomorrow. He retracts his insinuations about Microsoft money and the NEA. All in all he demonstrates what a little honest communication can do, a lesson that all of us who advocate for free software can take to heart. "The student did get his Linux disks back after the class. The lad was being disruptive, but that wasn't mentioned. Neither was the obvious fact that when she saw a gaggle of giggling 8th grade boys gathered around a laptop, the last thing she expected to see on that screen was a spinning cube. She didn't know what was on those disks he was handing out. It could have been porn, viral .exe's...any number of things for all she knew. When she heard that an adult had given him some of the disks to hand out, her spidey-senses started tingling. Coupled with the fact that she truly was ignorant of honest-to-goodness free software, and you have some fairly impressive conclusion-jumping. In a couple of ways, I am guilty of it too."

RIAA Agrees To Take $200-Per-File In Texas Case 154

NewYorkCountryLawyer writes "In a San Antonio, Texas case, Maverick v. Harper, in which a young woman was accused of having committed copyright infringement at the age of 16, the Judge denied the RIAA's summary judgment motion this summer, saying there were factual issues as to whether the defendant qualified for the 'innocent infringement' defense. He offered the record companies a way out, however, saying he would grant them a judgment if they agreed to take only $200 — as opposed to the $9,250 they sought from Jammie Thomas or the $750 they usually seek — per infringed recording. We have recently learned that, after the Judge denied the RIAA's reconsideration motion and scheduled a trial date, the RIAA filed papers agreeing to take the $200-per-recording amount. While $200 is still about 600 times the amount of the actual damages, it's better than paying 26,000 times the actual damages, which is what the RIAA tried to squeeze out of Ms. Thomas." This is a reversal of the RIAA's rejection of the $200 award per song last month.

'By making sure their software adheres to the test, the creators of these products can be more confident that their software will display and function with Web pages correctly both now and with Web pages of the future. The Acid3 Test is designed to test specifications for Web 2.0, and exposes potential flaws in implementations of the public ECMAScript 262 and W3C Document Object Model 2 standards.' Screenshots at the Drunken Fist site show the success of Safari 3 (which originally scored 31, but is now Scoring 87/100) IE6, and IE7 (massive fail, of course)'." The two groups claim to have signed up 30 new customers (including heavyweights like Costco and Southwest Airlines), but it will still be some time before any real changes will be felt. 'Regardless of what impact the deal has triggered in the marketplace over the past year, ultimately it's about meeting market requirements.
