All new innovation is based on someone's old innovation. Ever hear of Alfred Russel Wallace? -- probably not, but you've probably heard of most of his work through the guy who pretty much ripped HIM off (yet in the process made it more concise and with more applied observation!) Google, sleazy? Or Google, business... It's not like source code and design documents aren't "borrowed" constantly anyway...
Perhaps off topic but to address your comment on Darwin, my understanding is that Darwin developed his theory of evolution through natural selection well before Alfred Russel Wallace. He then shelved it for a time and returned to it when Wallace was prepping his work. Only important because you were implying that Darwin somehow read and copied Wallace's work and then presented Wallace's ideas as his own. If you have anything to show that Darwin did in fact plagiarize I would be interested in reading it.
